'Las Vegas Review-Journal Publisher Sherman Frederick likens copyright infringement of his newspaper's online content to the hypothetical theft of a classic Corvette from his front yard.

But in the real world, Frederick and his copyright enforcement partner don't appear to be making many friends among Corvette enthusiasts.

On Monday, the R-J's copyright enforcement partner, Righthaven LLC, filed a copyright infringement lawsuit in U.S. District Court against the owner of the www.corvetteforum.com website.

That suit, one of five federal cases filed by Righthaven on Monday in Las Vegas, listed as defendants Internet Brands Inc. of Los Angeles and Internet Brands Chief Marketing Officer Chuck Hoover.

The suit says an R-J story from June 20 called "Reid machine dwarfs Angle" was posted on the Corvette website without authorization.

Guess they don't understand the "fair use" law.

But most likely it'll be dismissed and encouraged to go after FreeRepublic.com which is notorious for failing to moderate their own people.

I'm not going to rejoice in this.  If it was only about copyright infringements, that could be handled by a simple takedown request.  I don't think it is.  These people are thugs using the courts to bully site owners into paying out large sums of money.

will be pointing out that the LBN is carefully crafted to follow the fair use law, and that the R-J a-holes are shooting from the hip and trying to snare $$ - it'll fail, and I'm hoping as a result of their idiocy, the corporation will have no choice but to liquidate their entire holdings.

Maybe DU can use Reid to lean on them to tell them to knock it off.

I think you're right. I think the lawsuits are filed in hopes of scaring the defendants into making out of court settlements. I'm no lawyer and don't have any background in law, but it seems like the proper order would be :

1. Filing a copyright infringement/takedown notice.
2. If number one fails, then file a lawsuit.

I'm being cautious and not hitting any links right now. Was there any mentions of the Digital Millennium Copywrite Act? If there is that's how they can glom up the domain name. There's lots of precedent for that.

The LV Sun article mentioned it, but R-H claims the DMCA doesn't apply because they were never formally contacted and asked for permission before the articles were posted online.
