If Dear Leader is determined to not be eligible for office of the President since he is not a natural-born American, does that put Biden in office as President?

The political and legal wrangling will certainly go on beyond Jan. 20 and, of course, Dear Leader will be crowned and ascend his throne on that date.

Senator Biden's a dufus enough as it is and as VP he's generally pretty harmless, acting only to break a tie in the Senate, but as President?

First of all, there's no way in hell that this issue is going to be challenged legally before the electors meet on Dec. 15. If you'll pardon the expression, there're too many politicians and lawyers involved.  

So that means that Dear Leader will ascend to the throne on Jan. 20.

After Dear Leader's ascension, and if it's determined he's not eligible to be President, I would think that Section 1 of the 25th Amendment would be invoked and we wind up with Veep Biden in the driver's seat.

By guess to ths would be that Biden would take over only after the Electoral College met.  If word of this broke before hand, I doubt the college would actually vote for him, thereby handing McCain a victory.

True dat. But still, barring some kind of last minute legal wrangling by SCOTUS (entirely possible, but I'll believe it when I see it), the electors will cast their ballots on 15 Dec putting Dear Leader on the throne.

SCOTUS will get off its collective ass and get shit done in a hurry, but only if somebody/something is holding a gun to their heads.

I simply believe that it's business as usual and Dear Leader will ascend the throne.

That duty very likely is a legitimate one, but how many with the keys to the armory would be willing to give that order?

Frankly, I don't think either will happen - Im convinced that the API thing is a hoax - I was just playing devil's advocate.

At this point, Supreme Court Justice David Souter's Clerk informed Philip J. Berg, the lawyer who brought the case against Obama, that his petition for an injunction to stay the November 4th election was denied, but the Clerk also required the defendants to respond to the Writ of Certiorari (which requires the concurrence of four Justices) by December 1. At that time, Mr. Obama must present to the Court an authentic birth certificate, after which Mr. Berg will respond.

If Obama fails to do that, it is sure to inspire the skepticism of the Justices, who are unaccustomed to being defied. They will have to decide what to do about a president-elect who refuses to prove his natural-born citizenship.
