Convenient: IRS Has 'Lost' Two Years of Lois Lerner's Emails

According to the House Ways and Means Committee, the IRS has "lost" two years of emails belonging to former head of tax exempt organizations Lois Lerner. The IRS doesn't have a record of her emails to outside groups or government agencies from January 2009 through April 2011, conveniently encompassing some of the same time when tea party groups were being targeted for extra scrutiny and possible criminal prosecution.

The IRS says the loss of emails is due to a "computer crash" and claims emails from or to Lerner from the White House, Democratic members of Congress, the Treasury Department, FEC and Department of Justice cannot be located. They do however have emails belonging to Lerner that she sent to other IRS employees.

 â€œThe fact that I am just learning about this, over a year into the investigation, is completely unacceptable and now calls into question the credibility of the IRS’s response to Congressional inquiries.

There needs to be an immediate investigation and forensic audit by Department of Justice as well as the Inspector General," Ways and Means Committee Chairman Dave Camp said in a statement.

“Just a short time ago, Commissioner Koskinen promised to produce all Lerner documents. It appears now that was an empty promise. Frankly, these are the critical years of the targeting of conservative groups that could explain who knew what when, and what, if any, coordination there was between agencies. Instead, because of this loss of documents, we are conveniently left to believe that Lois Lerner acted alone.

They do have a back up in case this happens. Every email sent out is replicated and stored separately to prevent anything being lost. So in effect, this is bull.

Not only is it replicated on the Exchange server, I guarantee they have it backed up not once but 3 times onsite and off site for disaster recovery.  Also there is retention policies for all government agencies.  This is such BS.

Courts have for years (maybe a couple of decades) effectively required corporations to keep archives of their email. Not being able to produce emails during discovery (in lawsuits) weighs heavily against defendants. And there are dedicated products specifically for this task (Barracuda Networks - to whom I have no ties or investment - has a series of such products, sized for a wide variety of corporations and divisions of companies). The idea that the IRS does not have systems that capture and archive emails at the time they are sent is just not credible.

IRS Commissioner Koskinen Lied Under Oath; Said Lerner’s Emails Were Archived

IRS Commissioner John Koskinentestified before the House Oversight and Government Reform on March 26, 2014. Koskinen told Rep. Jason Chaffetz (R-UT) during the hearing that Loise Lerner’s emails were archived and it would take a long time to retrieve them.

This week the IRS told Congress Lois Lerner’s emails were lost in a computer crash.
 Koskinen lied to Congress under oath.

This whole idea that they "lost" them has been debunked by every single(respectable) media outlet as federal law requires the IRS to keep multiple redundancies just so that this can never happen.  So if it is true(it isnt) then the people in charge of the IRS are in blatant violation of federal law and should be immediately arrested and thrown away for a very long time.


More importantly though is the reality that this is nothing but a giant lie.  This takes the IRS scandal from a "GOP witch hunt" right into the mainstream thought process.  Some independents could have ignored it before saying "its the GOP" but with this it is much harder to believe the IRS.


Oh and Issa demanded the head of the IRS show up on June 23, a very short time for a demand like that.  Its pretty clear that he is done playing games and is about to make things very difficult for the IRS.

Washington superlawyer Cleta Mitchell represents True the Vote, one of the groups illegally targeted by the IRS in the scandals that have exposed the agency as a partisan operation. True the Vote’s Catherine Engelbrecht has been harassed by federal law enforcement authorities representing three different federal agencies. They represent the price of politics in the Age of Obama.

Cleta has just served the letter below on the attorneys at the Department of Justice representing the IRS in True the Vote’s pending lawsuit referenced in the subject line below. She has also served the letter on Steptoe & Johnson partner Brigida Benitez. Benitez comes in for special attention in Cleta’s letter; she represents the IRS defendants who are sued in their individual capacity.

Late Friday, the IRS apparently advised the Ways & Means Committee that the IRS has “lost” Lois Lerner’s hard drive which includes thousands of Defendant Lerner’s e-mail records. However, several statutes and regulations require that the records be accessible by the Committees, and, in turn, must be preserved and made available to TTV in the event of discovery in the pending litigation. Those statutes include the Federal Records Act, Internal Revenue Manual ...

Therefore, the failure for the IRS to preserve and provide these records to the Committees would evidence either violations of numerous records retention statutes and regulations or obstruction of Congress.

Federal courts have held, in the context of trial, that the bad faith destruction of evidence relevant to proof of an issue gives rise to an inference that production of the evidence would have been unfavorable to the party responsible for its destruction. See Aramburu v. The Boeing Co., 112 F.3d 1398, 1407 (10th Cir. 1997). The fact that the IRS is statutorily required to preserve these records yet nevertheless publicly claimed that they have been “lost” appears to evidence bad faith. 18 U.S.C. § 1505 makes it a federal crime to obstruct congressional proceedings and covers obstructive acts made during the course of a congressional investigation ...

In addition to seeking responses to the questions in this letter, we also seek your consent to immediately allow a computer forensics expert selected by TTV to examine the computer(s) that is or are purportedly the source of Ms. Lerner’s “lost” emails, including cloning the hard drives, and to attempt to restore what was supposedly “lost,” and to seek to restore any and all “lost” evidence pertinent to this litigation.

We also seek access to all computers, both official and personal, used by any and all of the Defendants from and after July 1, 2010, in order to ensure preservation of the documents of all Defendants in this action.

Hopefully, the proceedings of this lawsuit may enable breaking through this latest stonewall much more quickly than Congress would/could.

This stonewall may increase Lois Lerner's (and her accomplices') legal peril. Not only are they on the hook for whatever consequences may arise from their illegal and tortious actions in their partisan targeting of conservative and Christian groups, now they may be on the hook for obstructing Congress, obstructing justice, and possibly evading all those records retention laws, if they used private email addresses for official business. And if Lerner, et al, were not consulted or made aware of the potential consequences of this, "The hard drive crashed my emails," ploy, it could backfire on the IRS higher-ups and Obama sycophants who are doing this. Lerner and/or some of her accomplices may be feeling, "Wait! I didn't sign up for this!" And start singing a tune the IRS higher-ups and Obama sycophants don't want heard!

To make it seem not so obvious, they are claiming that the emails of 6 others have been lost too. 

WTF? First is was because Lerner's computer crashed, but when it was shown that there had to be backups, by law, then those backups had to be lost.

Did Lerner's computer crash or was a server lost? Nope, just more lies from the Obama Regime.
