It was really only a matter of time before conservatives began invoking the "I-word" over President Obama's decision to release five Taliban detainees from the detention center at Guantanamo Bay in exchange for the only American prisoner of war in Afghanistan.

In the days following the prisoner swap that secured the release of Sgt. Bowe Bergdahl, some conservatives who have long fantasized about booting Obama from office believe they may finally have the goods for impeachment.

Andrew McCarthy, who's written an entire book that builds a case for impeachment against Obama, said in an interview published Monday he would include the Bergdahl release as part of his "larger indictment" against the President.

McCarthy told the MailOnline that the release of "senior terrorists to the Taliban" represents a "high crime and misdemeanor."

Judge Andrew Napolitano took it from there on Tuesday, telling the gang on "Fox & Friends" that Obama "may very well have committed a federal crime by giving material assistance to a terrorist organization."

Napolitano said impeaching Obama over the prisoner swap is a "very valid argument that people are going to start talking about."

I'll be honest here. I don't think this guy will be impeached in any way, shape or form for his entire presidency. The dumb bastard shoots himself in the foot and creates a scandal on a monthly basis it seems and it will stay that way for the next two years or so.  You'll have the Dems fighting it like hell because while they can say they managed to get the first black president elected, they damn sure don't want to be known as the party that allowed the first black president to be impeached.

On the other hand you have our "republican" leadership. Some of them are so complacent it is amazing they manage not to literally shit their beds at night because the toilet is too far away. As long as the gravy train isn't derailed, they couldn't give a dam. You have the other "republicans" who have gone so far left it's surprising they haven't come out already and just starting running on the Dem ticket (McCain). Throw in the fact, they run scared everytime a lib screams "racist" and you have a party that wants to sabre rattle, but not actually be known as the people who in fact impeached the first black president.

Impeachment based on this is a ridiculous bit of wishful thinking.  As I recall, the requirement is one of consultation, not consent, which means the President can do what he wants even if nobody in the entire Congress agrees with him, so all it effectively does is set up a 30-day waiting period.

Being the exchange of these Gitmo prisoners had already been brought up before, Obama knew that there was bipartisan, CIA and military opposition to doing it.

He chose to ignore all of them and do it anyway.  He's not running again and doesn't give a crap what anyone else thinks.  He's going to do what he wants.

These next two and a half years are going to be a real roller coaster ride to the bottom.  From here on out, I put nothing past him.

A president is still CINC. Congress cannot tell him who is a POW and what is to be done with them.

Even as unlawful combatants they fall under the GC where congress has less than no purview.

They can, however, make his life a political hell. Obama signed the law. He agreed to hold himself to that law. Now that he has shown his signature is worthless (yet again) they can cut his legs out politically and start drying up his sources of power, i.e. money.

Impeachment is a political exercise and remedy,no law needs to be broken although breaking a law would serve as a basis if the political will were there.
In this case there is not that will among elected officials nor the general public.

When you're the President or one of his appointees acting with his approval, that becomes 'Policy,' not treason, and I don't say that entirely as sarcasm, there is a fundamental truth about Executive power in it.
