I am disabled and unemployed and barely getting by paying the bills in my Fathers house, I am in the process of getting an SSI appeal hearing with an administration law judge, but the law firm I have says it will not be until October or November, maybe as late as December.

And then today I got a 30 day notice to get out of the house, from my half brother Butch, who has $32,000 in the house. He wants to sell it so he can get his money back.

Here is a photo of the letter I got from him today:



Now I have 30 days to find a place to live, and I have very little money to do it. So if you guys could make some donations and help me out I would be forever grateful.

If anyone has any ideas where I can get a place to live with almost no income and no job, please reply and let me know about it. And I was wondering if someone can tell me if the 30 day notice means I have to be out of the house by the end of the 30 days, or if I can continue to live in it until it is sold, or the 90 days he talks about is up.

In the letter he says the realtor has a guarantee he will sell it in 90 days, or he will buy it. Does anyone know if that means I can stay in the house while they are trying to sell it, or do I have to be gone by the end of the 30 days.

What if I refuse to leave, how long would it take to evict me?

Geez.... stewie's been beggin' since he bought that nice soft pillow for his dad last year, before he checked the insurance policy or find the will. You'd think he would have better luck applying his skills at fund raising in a more productive manner. He has the motor skills to have helped his dad adjust the new pillow just right and isn't too disabled that he can't operate a keyboard, run a website and post all day long to the DUmp from his brother's house.

But, I guess it just wouldn't feel right to ol' stewie to turn a honest buck while there are hundreds of DUmmies out there with more money than brains.

Go get it notarized at the same joint where Butch had his little letter done.

That'll give you six months, at least.

Don't move out. Go get some help at legal aid. Throw a yard sale to get some cash, if you're both inheriting, make sure you put half aside for Butch. He sounds like a cold hearted jerk.

I have a $40,000 balance on the current home loan with Chase bank.

And btw, I plan to call a free legal aid hotline Monday and see what they say about it.

Half brother doesn't own the house, he owns one third of the house. At time of sale, he will have to fork over your share in cash. A lawyer can help you untangle who owns what and who owes what to whom.
 
Solutions will happen according to whether or not he had the proper paperwork done at the time and whether or not you and your brother together will be able to float a second mortgage to cancel his lien and get him off the title.

The paperwork looks good to me, but I am not a lawyer, and btw, butch used to own a mortgage company so he knew what he was doing when he paid off that $32,000 2nd mortgage, I am pretty sure he had his lawyers telling him what to do to make it legal.

Don't know Illinois law but chances are it'll take longer than 30 days to do all the brother needs to do. But stewert is eventually OUT!! (This is all dependent upon stewert being accurate regarding all that's going on, and when it comes to that, who knows.)

Butch has his name on the deed,that is the legal instrument of ownership.
The Realtor is likely aware of the situation and if willing to be involved then he knows the legal aspects.
There is no estate to settle as the house was disposed of previous to death.
Steve I guess can sue his family to recoup his money but no idea how that would work out.

What bothers me about this whole mortgage deal is that stew's paternal ancestor was circa 90 years old when he died a couple of years ago.  There ideally should've been no mortgage, it having been paid off a long time ago, given the guy's age.  Most ancient people, if they've owned their home a long time, own it free and clear.

I suspect this mortgage was taken out to subsidize stew.

Welll... we got a little problem here. Assuming this is true.

Let us look at the so called facts:

1. Dummie's dad had a 2nd mortgage.
2. Dummies brother paid it off and had the house put in his name.
3. Dad took out a third mortgage on the house. The house that is no longer in his name?
4. dummie claims the will said the dummie and second brother are cowners.

First off... any bank worth their salt is gonna demand the deed. If it ain't in Dad's name, no mortgage. Unless the brother cosigned for the mortgage. If so, that changes everything. Seems to me the 3rd mortgage bank would have first dibs on the house from the estate or if it is indeed in brothers name, then he owes it.

This BS just don't add up. Now there could be other things going on here. Like brother owns the house but dad can live there until death. Mom got that on her house.  Still don't think the bank is gonna do a mortgage on a setup like that. Unless it was secured by something other than the house.

Like I said... this don't pass the smell test. Not a bit of it.

Personally I think the dummie is lying and the original scenario is true. The dummie wants to raise the 32,000 and some extra to boot. Dummie's brother is gonna kick his worthless butt out to the street. At least the brother waited until after winter.

Edited to add:

BTW... what attorney worth his salt is gonna tell his client to give his brother a hand written note? I understand that it was notarized, but all that means is the person that signed it is indeed who the note claims it is.  No notary worth his/her salt is gonna notarize a hand written note. I know, I was a notary public years and years ago. Not for something like that. At least I wouldn't do it.
