Des Moines imam files motion to dismiss sexual exploitation charges, argues charges violate religious freedom

An attorney for a Des Moines Islamic leader charged with sexual abuse and exploitation is asking a judge to drop two of the charges, arguing that they violate the man’s religious freedom.

In a motion to dismiss filed last week in Polk County District Court, Des Moines defense attorney Angela Campbell argued that Nermin Spahic, 40, had never met the two women who accused him of sexual abuse before the day of a religious ceremony that led to his arrest. The motion also says that Spahic never claimed to offer “mental health services” or counseling.

Why do we let these ba$#ards stay in our country? Deport his molesting a$$ back to wherever Islamic hell-hole he came from.

(snip)

Under Iowa law, therapists and counselors are not allowed to participate in any sexual conduct with their patients, but Campbell is arguing that Spahic does not fall under this law because he had no formal relationship with the women.

The woman called Spahic to her home for help with her daughter, whom the woman claimed had been dealing with depression and drug use. Spahic allegedly performed a religious ceremony that involved rubbing the body with oils, and that is what the women are considering to be sexual abuse. Police arrested Spahic shortly thereafter.

While Spahic awaits trial in December, he and his lawyer are doing what they can to try and get the exploitation charged dropped on the grounds that his religious freedom has been violated.
