Legal questions any lawyers on CC?

This came up this afternoon and I can't get a hold of my attorney till Mon.

I bought a mobile home for my son in a park with a co-op 4 years ago, and still own an interest in it, he is being evicted and I called a local mobile home mover to come look and give us an estimate to move it to some property i own. Two days later a board member called and told me the trailer cannot be moved as the axles had been removed and they want to make me an offer on the trailer. I just wonder if I have any legal rights in this situation? Seems to me I was sold a "mobile home" that is not mobile! The person who sold it to me is also a board member in this park.

The movers should be able to supply axles/wheels for the move.

Yeah, I was wondering if you had heard back from the actual movers and why was it that the board member informed you that it couldn't be moved.

I am also wondering if the mover that you called is associated with the park/co-op.

But yeah, I think AM is right in that a mover would be able to supply axles.

Why not just sell it to them for the cost of a replacement of equal worth (or better) including the set up costs?

The mover said he could move it. He says he has a special lowboy trailer for the job but the price goes way up. Its already a bit to much because of the distance. My land is in the next county. They made me an offer tonight for about half of what I think its worth. I'm thinking I should do it and be done with it. I've go a headache! I think my issue is with the seller and not the park.

A lot depends on whether your state regards it as a fixture or real property once the axles are off it, which could be different in different states.  Go back to them with a counteroffer of what you think it's worth minus the cost of hauling it out and see what they say, with 'Splitting the difference' being a perfectly reasonable end point after the ensuing haggling is done.  Worst case you can take their offer, but you might as well make them work for it and you might well come out better on the deal if you do.
