That may be a procedural requirement.

Issa has said she will be called back.  When she made her statement, she waived her right to be covered by the 5th.

House Oversight and Government Reform Committee Chairman Darrell Issa said embattled IRS official Lois Lerner waived her Fifth Amendment rights and will be hauled back to appear before his panel again.

The California Republican said Lerner’s Fifth Amendment right to avoid self-incrimination was voided when she gave an opening statement this morning denying any wrongdoing and professing pride in her government service.

“When I asked her her questions from the very beginning, I did so so she could assert her rights prior to any statement,” Issa told POLITICO. “She chose not to do so — so she waived.”

Lerner triggered the IRS scandal on May 10 when she acknowledged that the agency wrongly targeted conservative groups applying for a tax exemption. Her lawyer told the House committee earlier this week that she would exercise her Fifth Amendment.

That's fine and dandy, but when they drag her back in front of the committee and she refuses to speak, what then, Issa? What do you do? Declare her in contempt? Take away her birthday? Make her stand in the corner?

Yeah, but isn't it prosecuted by the DOJ? Think Holder is going to do anything?

Lois Lerner Sued Christian Coalition In Largest FEC Action in History – Then Was Promoted to IRS Where She Targeted Conservatives

Under the direction of Lois Lerner, the Federal Election Commission sued the Christian Coalition in the 1990s. She harassed the Christian Coalition for three election cycles. She lost her case. Lerner even asked one conservative during the case if Pat Robertson prayed over him.

These actions landed her at the IRS where she used the same tactics against conservatives and Christians – only on a much larger scale. 500 conservative and Christian groups were illegally targeted by the Obama IRS during her tenure. For twenty-seven months the Obama IRS refused to approve any Tea Party applications for tax-exempt status. At the same time the Obama IRS approved dozens of progressive application.

Meh. Much like that second amendment, the fifth has outlived its usefulness. Lets get rid of it

Would hear or prosecute the case?

Do you honestly think that this guy, an Obama disciple/appointee, would actually prosecute Lerner to any degree?

He'll make her stand in the corner and might possibly take away her birthday. For a day or two. After that? Crickets....

In this current environment with Holder and Obama in the driver's seat, I'm not sure a special prosecuter is a good idea.

Why not?

A special prosecutor, by definition, does not answer in any way to Dear Leader or his buddy DickHolder. Remember, as much as he may have wanted to do more, the only thing Der Schleikmeister could do to Ken Starr was stonewall him. He couldn't fire him, couldn't re-assign him, couldn't even de-fund his budget.

A special prosecutor is exactly what we need here. Unfortunately, I don't see John Boner & Company as having the testicular fortitude necessary to sic a special prosecutor on his golfing buddy.

IRS Puts Lois Lerner on Administrative Leave… With Pay

Lois Lerner, the Internal Revenue Service’s director of exempt organizations, has been placed on administrative leave, according to a source in the agency’s Cincinnati office.

Lerner on Thursday afternoon sent an e-mail to employees in the exempt-organizations division she oversees stating, “Due to the events of recent days, I am on administrative leave starting today. An announcement will be made shortly informing you who will be acting while I am on administrative leave. I know all of you will continue to support EO’s mission during these difficult times.” She concluded, “I thank you for all your hard work and dedication,” adding, “The work you do is important.”

Should we be surprised?  Obama has paid Nidal Hasan over $278,000 for murdering military personnel.  Yes, I blame Obama for that, he could have ordered that Fort Hood be treated as a terrorist attack.

IRS official who refused to testify, resign signed Tea Party letters in 2012

The IRS official who refused to testify this week -- while claiming she had done nothing wrong -- signed letters to Tea Party groups a year ago that asked them to turn over everything from printouts of their Facebook pages to the credentials of speakers who participated in their events.

A group representing more than a dozen Tea Party groups now suing the IRS released a sample of one of the letters overnight, after the official Lois Lerner was placed on administrative leave. According to one lawmaker, she was only placed on leave after she refused to resign.

Jay Sekulow, chief counsel with the American Center for Law and Justice, said the March 2012 letters show a "paper trail" that reveals her "direct involvement in sending intrusive and harassing questionnaires."

Actually, that's pretty standard fare.

Companies generally don't want the rank and file to talk to the press. Policies are put in place to refer employees who are approached by the press/public with questions to refer to the designated public affairs office.

The cop angle was pure intimidation, though. No doubt.

Lois Lerner To Republican Candidate In 1996: “Promise me you will never run for office again, and we’ll drop this (FEC) case”

The IRS scandal may have its roots in Illinois politics. Specifically, the 1996 U.S. Senate race between then-Democrat Congressman Dick Durbin and conservative Republican State Rep. Al Salvi.

More than a decade before his 2010 letter to IRS officials urging the agency to target conservative organizations, U.S. Senator Dick Durbin’s political career crossed paths with Ms. Lerner when she was head of the Enforcement Division of the Federal Election Commission (FEC), and directly involved in the 1996 Illinois U.S. Senate race.

Soon after the IRS story broke, Al Salvi told Illinois Review that it was IRS official Lois Lerner who represented the FEC in a Democrat complaint against him. According to Salvi, Lerner was, without question, politically motivated, and went so far as to make him an offer: ”Promise me you will never run for office again, and we’ll drop this case.”

Salvi declined her offer, and ran for Illinois Secretary of State in 1998.
