IRS facing class action lawsuit alleging improper access of 10M health records

The Internal Revenue Service is now facing a class action lawsuit over allegations that it improperly accessed and stole the health records of some 10 million Americans, including medical records of all California state judges.

According to a report by Courthousenews.com, an unnamed HIPAA-covered entity in California is suing the IRS, alleging that some 60 million medical records from 10 million patients were stolen by 15 IRS agents. The personal health information seized on March 11, 2011, included psychological counseling, gynecological counseling, sexual/drug treatment and other medical treatment data.   
 
"This is an action involving the corruption and abuse of power by several Internal Revenue Service agents," the complaint reads. "No search warrant authorized the seizure of these records; no subpoena authorized the seizure of these records; none of the 10,000,000 Americans were under any kind of known criminal or civil investigation and their medical records had no relevance whatsoever to the IRS search.

IRS sued for seizing 60 million medical records

A healthcare provider has sued the Internal Revenue Service and 15 of its agents, charging they wrongfully seized 60 million medical records from 10 million Americans.

The name of the provider is not yet known, United Press International said. But Courthouse News Service said the suit claims the agency violated the Fourth Amendment in 2011, when agents executed a search warrant for financial data on one employee – and that led to the seizure of information on 10 million, including state judges.

The search warrant did not specify that the IRS could take medical information, UPI said. And information technology officials warned the IRS about the potential to violate medical privacy laws before agents executed the warrant, the complaint said, as reported by UPI.

If UPI is right and this suit is seeking $25,000 in compensatory damages per violation and the seizure impacts up 1 in 25 Americans, this is big. Especially Californians, since this wouldn't have crossed state lines, making it more like 1 in 3 Califonians with health insurance.

No, let's take that statement at face value. That means that they had no "right to know", which is a requirement under HIPAA to access records without approval. Therefore, merely POSSESSING the records is a federal crime, and the AGENTS are PERSONALLY liable for fines and/or jailtime. Now, I've never interrogated someone, but I would think that offerring immunity for testimony would be a pretty good lever.

In March 2011, IRS agents used a search warrant to seize the medical records from an unnamed California health care provider in its pursuit of a tax violation by a former employee of the company, according to Courthouse News Service. The suit, filed March 11, 2013, claims that the search warrant did not authorize the seizure of medical records of those who were not suspects in the case. More than 60 million medical records of more than 10 million Americans were seized, according to the complaint.
