The Boston Marathon bombing suspect captured Friday night will not be immediately read his Miranda rights, a Justice Department official said.

The announcement came as a debate broke out among lawmakers, lawyers and political activists over whether the suspect, Dzhokar Tsarnaev, should be prosecuted in a civilian criminal court or subjected to military interrogation and over when and whether Tsarnaev should be told about his right to an attorney.

eginning several hours before Tsarnaev’s capture, Sen. Lindsey Graham (R-S.C.) wrote on Twitter that the suspect ought to be placed in military custody.

“If captured, I hope Administration will at least consider holding the Boston suspect as enemy combatant for intelligence gathering purposes,” Graham wrote Friday afternoon. “The last thing we may want to do is read Boston suspect Miranda Rights telling him to ‘remain silent.’”

Supporting President Obama 150% on this one! Charge, convict and punish Dzhokar Tsarnaev with the Death Penalty!

OK, someone who actually thinks that sometimes the "rights" are actually pragmatic when it is a terrorist act, and actually credits Der Leader for this. So even in contradiction to the thread, he gives kudos to the one who has screwed the pooch with regard to international terrorism.

But I think it's still wrong and unconstitutional.

If he wasn't a citizen I'd entertain the idea, but he is, and he was caught on US Soil.

So this should be a no-brainer to read him his rights.

They're invoking a SCOTUS "public safety exception" to

Miranda. So the idea is that any statements will be admissible. It's an odd, narrow exception based on a case where cops cornered a guy, saw his empty holster, and demanded to know where the gun was hidden before they read him his rights. If the statement had been inadmissible, apparently the whole case would have been tossed.

Strange thing publicly announcing invoking this. The case reads like it's something a cop would decide, on the spot, was necessary, not something you plan out and announce.

Not a great way to go here, in my opinion.

Seeing that picture of that asshole getting medical treatment reminds me of just how special someone has to be to be in the medical field. They have to save the lives of some horrible people and treat them just as they would the innocent victims that these assholes hurt.

I may not lock my doors while sitting at a red light and a black man is near, but I sure as hell grab on tight to my wallet when any democrats are close by.

Note to DUmmies...there are special exemptions for "public safety" when the reading Miranda Rights can be delayed.

These two were planting bombs all over Boston...who knows how many could still be out there under a bridge in a subway car or on a bus waiting to go off.

If they Mirandize him right now...he'll lawyer up and where those bombs are will never be known until they go off.

This way they can sweat him for the location of any more bombs that might have been hidden...once they are sure he's being truthful and the locations of all unaccounted for pipe and pressure cooker IED's are known...then they can Mirandize him.

Not that the law and how it's written matters to you f**ksticks.

As I said elsewhere...if it were up to me...once he's well enough to travel...I'd drag him out to Logan and put him on a flight to Russia...final destination...Lubyanka Square and the building near where the statue of Iron Feliks used to reside.

Hey DUmbasses, he has been taken into custody, not arrested yet.

From the looks of him he would have had no idea if they did it or not. Blood loss alone will alter his mental status enough that he may not even have known his own name at that point. They will get him stable at the hospital then he will be placed under arrest and read his rights.

If they had read him his rights at the scene you morons would be peeing in your panties that he didn't understand them. :loser:
