Mark Kelly may have committed a felony when he purchased his AR-15.  â€˜Longknife’ at The ObamaFile reported:

If Mr. Kelly did not intend to keep the AR-15, but to give it to another, he is committing a felony by being a “straw purchaser” under current law, and he must have stated on the ATF Form 4473 that he was buying it for himself, so he committed perjury on the BATF form, also a felony.

Copy of Question 11a of the 4473 at the link, which states quite clearly that you are NOT allowed to buy for another person.  While it might be a stretch to say he "must have stated" as such on the 4473, I'd sure as hell love to see that, and who he gave the weapon to, and when, after he purchased it.

HOW MARK KELLY'S AR-15 COULD END UP ON THE STREETS
When gun control proponent Mark Kelly announced he was going to hand his AR-15 over to Tucson PD once he picks it up, it seemed he was trying to give the impression that he's doing his part to get such firearms off the streets. The problem is, Arizona law may not allow that scenario to play out.

In fact, Arizona law may require the Tucson PD to sell the gun to a private citizen once they take possession of it.
This is because the Arizona house has already passed a bill--HB 2455--which adds voluntarily surrendered guns to the list of guns that cannot be destroyed. Instead, they must be treated as "assets" that can be sold to make money to help balance budgets.

HB 2455 is in the Arizona senate now, and it if passes there, it could be illegal for the the AR-15 Kelly bought to be destroyed after he turns it in to police.

Gun Shop Rescinds AR-15 Sale to Lib Mark Kelly – Questions His Intent

A Tucson gun store owner has decided to rescind the sale of a military-style rifle to Mark Kelly, the husband of former U.S. Rep. Gabrielle Giffords, after Kelly said he had intended the purchase to make a political point about how easy it is to obtain the kind of firearms he’s lobbying Congress to ban.

A background check took only a matter of minutes to complete, Kelly said in the Facebook post, adding that it’s scary to think people can buy similar guns without background checks at gun shows or on the Internet.

But Kelly couldn’t immediately take possession of the rifle because the shop had bought it from a customer. As a result, the store is required by a Tucson ordinance to hold the gun for 20 days to give the city enough time to make sure the weapon wasn’t used in a crime.

Store owner Doug MacKinlay said Monday in a Facebook post of his own that he “determined that was in my company’s best interest to terminate this transaction prior to his returning to my store.”
