Another ****ing case of IOKIYAR???! I seem to remember a few Bush recess appointees like...John Bolton!!

While the president surely suffered an unexpectedly bad result, the D.C. Circuit’s opinion Friday is far from the last word on the subject. The administration could ask the full bench of the appeals court to take up the case. The Justice Department could also try to take the case to the Supreme Court.
Several lawyers said Friday that one of Obama’s best hopes at the moment is that the very expansiveness of the D.C. Circuit’s decision will undermine it.
“If this ruling is upheld, as a practical matter, it will negate the president’s recess appointment power. He won’t have it any more,” said one prominent D.C. lawyer who asked not to be named to avoid complicating cases handled by his law firm. “It really is a big deal.”

And the problem with 0bama not having the power to do recess appointments is?
The DUmmies howled when Bush did it, and I hated it when he did it, but he never did it when congress was still in session. I think that no president should have that power unless it is a major emergency, but even then if there is a vacant spot there is always a second in command that can act in that position until the Senate can confirm a replacement.

What I think is going to happen is the SC is going to put this off and by the time it gets heard 0bama will be out of office, and the defense will be, "At this point in time, what difference does it make?".

I am still incensed by the fact that Holder was found in contempt of congress, the only time that has happened in American history, and NOTHING was done about it.  That's just about the height of hubris in my book.

Agree completely.  If such isn't the case, why keep the Asst./2nd around?  There is nothing that happens that cannot wait for Congress to reassemble in session.

It irks me that this case was brought to court by a "civilian" and not a GOP member of congress.  Congress took no action regarding the illegal appointments AFAIK.
