I disagree with the DUmmies assertion that he should have an enhanced sentence as a hate crime because the victim was a queer. No class of people warrant special distinction.

Crime victims are not all in one class, some are 90 years old, Even Rosa Parker in later years had her neighbors break in and rob her blind.
Can one place rape of a child in the same category as rape of an adult ?????
This crime had nothing to do with personal gain, like most gay bashing the victim is seldom robbed just beat up by strangers. All crime that has no gain for the criminals are Hate Crimes.
Example, some one steals your motorcycle, non hate crime, someone sets it on fire, hate crime.
Fortunately we have laws and regulations that take into consideration that all people are different, age sex, abilities or lack of them. A blind person cannot be expected to protect themselves the same as the seeing, a 80 year old cannot be expected to have the reflexes of a 30 year old. A 3 year old child cannot fight back from a rape as a 15 year old can.
We have come along way since all laws applied to all people. We no longer place sand bags on the ankles of 4 years old to hang for stealing a crust of bread next to adults that have done the same.
Classes, the pedophiles, the thrill killers, those with an IQ under 70, children under 13 that wipe out their parents and the parents that wipe out their kids.
ANYONE that were to hit my Mom and was charged with simple assult I would go NUTS on. Anyone that hit my 5 year old grand child and charged with simple assult I would go NUTS on. Classes of the victim, were my family be attacked for being Christian, gay or color of skin, no other reason but they exist and others don't like it and family member ends up beaten half to death ?????
