I heard it from a couple of sources Friday. Not 100% ironclad, but the consensus is that it'll be a body blow to Obama. Maybe even 6-3.
I'm afraid that the price of getting Breyer on board would be a
too-respectful opinion, one that doesn't include a direct command to the Executive branch in its entirety to halt all implementation (ie, a cease and desist). The Obama admin certainly
cannot be trusted to cease all implementation based on a full deletion of the law without being also
directly commanded to.
We can write off the 3 dames. And I'd guess that if it's 5 men on one side and 1 man and 3 women in the dissent, or especially all the men (6) on one side and the 3 women on the other, this'll get incorporated into their ersatz "War on Women" narrative.
