CBS/KHOU/AP) CLEVELAND, Texas - Police say the gang rape of an 11-year-old girl was captured on cell phone video, according to a search warrant affidavit obtained by several Houston media outlets. Eighteen juveniles and adults are accused of sexually assaulting the girl at an abandoned mobile home in Cleveland, Texas.

Police say the lurid video circulated at a small Texas middle school.

The girl, who police have not named, told investigators she was raped at the home on Nov. 28.

Indictments in the case say there also were attacks on Sept. 15 and Oct. 25. Each time, at least two individuals were allegedly involved. The indictments say the girl was attacked by at least three people in November.

Both police and prosecutors have declined to discuss details of the case.

So far, well over a dozen suspects have been arrested in the case, some of whom are juveniles and students.

Investigators believe there could be even more suspects.

"I've heard as many as 28 or more. The case now has 16, 17 people who have been arrested," defense attorney James Evans III told CBS affiliate KHOU.

There was a case in Texas not so many yrs ago ,a guy raped and murdered a woman. They caught the guy and right away the dudes lawyer convinced him to cop a plea to the murder to get the death penalty off the table. So it was agreed no death penalty for the murder. The state went for the DP for the rape and got a conviction because the dude coped to the rape in the murder plea deal. conviction held up under numerous appeals and the dude eventually got the deep sleep.

I AM a fan of Court TV and watching how the system works blows my mind.  A 5-10 year sentence means the monster will be out in 18-24 months with good behavior.  This is so sick it makes me want to cry as the child will still be only 13-14 years old when the monsters get out to walk the streets again.

I PRAY for the family's of all involved, life for the family's has changed forever and not for the good.     BTW I wonder if any of the monsters are out on bail at this time ????

(B)  unlawfully and with force removed, or was attempting to remove unlawfully and with force, the actor from the actor's habitation, vehicle, or place of business or employment; or

(2)  did not provoke the person against whom the force was used; and

(c)  A person who has a right to be present at the location where the deadly force is used, who has not provoked the person against whom the deadly force is used, and who is not engaged in criminal activity at the time the deadly force is used is not required to retreat before using deadly force as described by this section.

(d)  For purposes of Subsection (a)(2), in determining whether an actor described by Subsection (c) reasonably believed that the use of deadly force was necessary, a finder of fact may not consider whether the actor failed to retreat.



Sec. 9.33.  DEFENSE OF THIRD PERSON. A person is justified in using force or deadly force against another to protect a third person if:

I also agree with Gina, up until recently I was sharing her hometown, and was looking for housing close by work. Some nice neighborhoods, but the vast majority of my neighbors would have been black. What about the Texas case where the Perp Kidnapped , Raped and murdered a female and plead to the kidnapping and murder of the victim to get the DP off the table on those charges. Then the state of Texas tried him for the rape and gave him the DP ?

Victim did get killed, though.  That's the test, regardless of the charges.  The perp's lawyer apparently didn't realize the DP was in the rape and/or kidnapping statutes for sufficiently-aggravated cases...if the perp killed the victim, then that aggravated penalty would still pass muster under the Supreme Court case.
