As some of you my recall I rolled my car back in mid-July. The responding deputy ticketed me for unsafe speed for road conditions, doing 40 in a 30. A few weeks ago I was soliciting advice for a legal term that would encapsulate the gist of my argument that the deputy was just pulling things out of his ass.
Apparently the legalese term for that is "Arguing facts not in evidence" and thank-you to the tanker that is something of a dumbass for that advice.
I just got back from the trial where the judge dismissed the charge.
It was rather interesting because I shot the shit out of the officer's case. That's not a slight on him but it was amazing just how many holes were open to me.
First, he said the accident happened in August, it was July. Then he said I told him I admitted going 40mph. I'm smarter than that and would never say 1 way or the other. Thenhe said the posted speed was 35 but for road conditions he felt 30 was too fast; I pointed out the posted speed at the corner is actually 20 mph not 35, and my tine Saturn wouldn't hold those muddy roads at 40, since it isn't as heavy as a police cruiser.
The judge said he thought I must be guilty of something but the deputy failed to provide any evidence so the case was thrown.
Afterwards the deputy and I had a cordial conversation where I thanked him for being professional and courteous. (TRANSLATION: Please don't hit me in the kidneys with your nightstick)
