An Arizona judge has struck down the Recording Industry Association of America's claim that making music files available constitutes distribution of those files. U.S. District Court Judge Neil V. Wake denied the RIAA's request for a summary judgment against a couple who had copied music files from their CDs onto their computer and downloaded file-sharing programs. The defendants said they never placed the music in a shared folder. The judge concluded that even if defendant Jeffrey Howell had placed the items in a shared folder, a third party would have to dip into his hard drive to retrieve a copy....

Ah, the RIAA -- just like Emperor Palpatine, the tighter they close their grip, the more money slips through their grasp.

They just don't get it.  There is a good reason why the music industry is losing money hand over fist:  Music today (what little there is) sucks and their distribution model is so 20th Century.

Looks like The RIAA may have trouble with trying to sue any more kids and old people,LOL. This pretty much kills the current lawsuits they have in Nebraska over the use of the colleges (University of Nebraska) internet network.  :cheersmate:

If I bought a tape or a vinyl LP, then I own the right to listen to that on any medium anywhere anytime. 

The real pirates are those who never paid for the original material.
