No to Chairman Leahy's online piracy bill act S.968

It would be nice if this bill were just about stopping Piracy that Socialist Leahy of Vermont was proposing, but it is not.  You see if you use images like that Geico caveman I see when I registered for this forum, the Justice Department who won't even charge the Black Panthers with voter intimidation in Pennsylvania and Homeland Security who won't even protect are borders from Mexican Drug Cartels and illegal aliens would have the authority to shut down your website without Judicial Process.  It would put sites at risk for even just putting up a picture.  

Plus when doing a search on lets say Google or Bing certain search contents would be blocked out from the search allowing cersorship of content on the internet.

Even putting links up to news articles like the 2 below could get your webpage shutdown by Eric "BLACK POWER" Holder and Janet "ANITA HILL ATTORNEY" Napolitano.  This bill could shut down websites like Drudge for linking news articles.

I have no idea why Fox news and other outlets don't report about this bill.  The justice department and Homeland Security could block out the tea party website so we the people don't know about meetings.  What kills me is Hatch a Utah Senate Republican and Grassley a Iowa Republican support this bill when the Republicans promised with the Contract With America a free and open internet.

I agree that it will be dangerous to even quote a news article in a forum, there IS an ulterior motive for this bill.
The focus on Piracy is just a distraction. The real purpose is to shut down conservative websites before the election.

Hi I am hear to warn people about a bill that would make streaming News Videos on YOUTUBE, METACAFE, DAILYMOTION whatever you stream news on a crime punishable with JAILTIME, this bill S.978 would make it a felony for up to 10 years in prison.  The bill proposed by a REPUBLICAN Lyer to the CONTRACT WITH AMERICA FOR A FREE AND OPEN INTERNET John Cornyn (R-TX) and a Democrat named Amy Klobuchar (D-MN) from the Al Franklin State of Minnesota would scare people from putting and streaming serious news videos online because of the fear of jail time.  The bill of course is in the name of copyright infringement.  While S.968 THE PROTECT IP ACT that would shut down websites that the Justice Department and Homeland Security deemed as online piracy, and would do so without jurisdiction has been stopped because a Democrat named Wyden from Oregon who put a block on the bill temporarily, this S.978 would make it a crime to stream any news video and would land you in jail.

S.978 was approved today which means that even if I watch a video on YOUTUBE that is news footage from CNN or FOX the Government decides what is piracy or not and can put me or you in jail for just clicking play on YOUTUBE. 

Bloomberg news tells us exactly what this bill will mean once it is signed into law.

loophole in the streaming media law has been closed by the US Senate, which could land culprits in prison for up to 5 years. They have approved a bill making it a felony to stream copyrighted content that was unlawfully obtained.

 
Illegal streaming could lead to jail
The bill which is called the Commercial Felony Streaming Act, aims to “reconcile a disparity” between current streaming laws and peer-to-peer (P2P) file sharing. The current ‘loophole’ makes a crime of downloading or uploading copyrighted material, but streaming is not prohibited.

The bill will make it illegal to stream illegally obtained media for commercial purposes, and comes with the threat of a five years sentence. The bill says a person would be charged when the “offense consists of 10 or more public performances by electronic means, during any 180-day period, of 1 or more copyrighted works.”

NEW YORK (MainStreet) — The federal government has taken the war against digital piracy to the next level by cracking down on websites that stream copyrighted videos without permission.

This week, the U.S. Senate Judiciary Committee approved a bill that would amend existing copyright law to make it a felony punishable by jail time for a website to stream (or broadcast) movies without permission.

Until now, it has been considered a felony to illegally reproduce or distribute copyrighted works by downloading them, but streaming has been classified as a “performance” rather than distribution and has therefore been exempt from this rule.

The new bill, which must still be approved by the full Senate, would change the standard to include those websites that make a business out of streaming video. If a website streams 10 or more videos in a six-month period, and if the value of the broadcast is worth more than $2,500 and the value of the copyright licenses are worth more than $5,000, the owners would be subject to as much as five years in jail.

“Make no mistake: the illegal streaming of content for commercial or financial gain is a crime, and the Commercial Felony Streaming Act places the appropriate criminal label on the activity,“ the Screen Actors Guild said in a statement in conjunction with the American Federation of Musicians and several other entertainment groups after the bill was approved. “This legislation is an important step forward in our efforts to stem the rising tide of Internet theft that threatens our members’ very livelihoods.”

Illegal downloading has been on the decline, but as MainStreet has reported previously, much of this can be attributed to the rise of streaming services – many of them legal – like Netflix and Pandora that allow users to get much of the same entertainment for free or through a small subscription fee.

In recent months, legislators have become more aggressive in trying to police the streaming market and choke off what may be one of the last strongholds for digital piracy. The Obama administration released a lengthy wish list of intellectual property regulations in March, which included a recommendation to make streaming copyrighted videos a felony.

While supporters of the measure emphasize its potential impact on websites that stream movies for commercial gain, if the bill is passed, ordinary consumers who play the movies at home could also be at risk.

As many of you know S.978 is a bill that is meant to stop copyright infringement on YOUTUBE and other streaming websites.  If you are found embedding, watching one COPYRIGHTED material according to this bill it could mean 5 years in prison or A HEAVY FINE $5,000.

But this bill S.978 also makes it a crime to:

- Youtube Karaoke

- Homemade web videos with music

- Videos of public performances

- Videos of parties that include background music


THE BILL'S LANGUAGE SAYS IT IS CONCENTRATING ON "PUBLIC PERFORMANCE."

This bill could have effects on the Tea Party having a rally and some idiot playing copyrighted music in the background and as a result the Tea Parties YOUTUBE channel could be shut down and the person embedding the Video could face fines or jail time.

Prince and Warner Bros one time tried to file a lawsuit against a mother and her baby that she was filming walking because a Prince song was playing in the background and actually had YOUTUBE remove the Video from her YOUTUBE channel.

Number of ISPs reportedly on the verge of an agreement with the entertainment industry to combat online copyright infringement; White House “instrumental” in brokering the deal; disconnection optional.
US ISPs are nearing an agreement with the entertainment industry to sanction customers repeatedly accused of copyright infringement, this according to a report by CNet.

If all goes well the deal could be finalized as early as next month.

Details of the plan are still somewhat murky, but it appears that ISPs have a “menu” of responses to choose from. They can choose after how many infractions to disconnect infringers, require copyright law education classes to resume service, bandwidth throttling, and even limiting web access. Disconnection is not required under the proposal.

The White House was purportedly “instrumental” in brokering the deal between the two. Last June it made the fight against intellectual property theft a top priority in its Joint Strategic Plan On Intellectual Property Enforcement. Since then the U.S. Immigrations and Customs Enforcement (ICE) has seized more than 100 domain names accused of infringement and members of Congress are pushing to pass the PROTECT IP Act.

The PROTECT IP Act would give the Attorney General the power to force US based third-parties, including ISPs, payment processors, advertisers, and search engines to either block access to an infringing site or cease doing business with it. Copyright holders would be able to target payment processors and advertisers.

The RIAA, in particular, has been pushing ISPs to sanction repeat infringers since at least 2008 when it discontinued the practice of suing individual for illegal file-sharing. RIAA head Mitch Bainwol said at the time that he believed the new strategy will be more effective since it will be able to target more people at the source – Internet connections – and move away from costly litigation.

And he’s right, especially if ISP sanctions are predicated simply on accusations made by copyright holders and not independently verified proof.

Worse still is that the agreement calls for ISPs and copyright holders to split the costs of the plan by an unspecified ratio. This means that whatever costs are to be borne by ISPs will be passed along to consumers in the form of higher monthly bills; that’s right, consumers get to pay for the entertainment industry’s doomed plan to somehow try and rid the Internet of infringing material. So even if you’re an otherwise law abiding citizen you get to cover the cost’s of a poorly conceived approach to fixing a failing business model.

If ISPs do agree to implement a copyright infringement regime then we may likely see the unintended consequences of an end to open Wi-Fi in public places, and entire households facing the repercussions of an improperly secured router.

If the internet becomes corrupted there are other means to comunicate, have been for YEARS, the young folk do not know this, but us old timers do.   

Go to the Bible, brass was used with the suns rays to communicate with others 40 miles away.    Indians used smoke signals to speak.  Way back in time drums were used to  communicate things almost like Morse's code.

Oh No the internet is taken over by the government, what to do for the youngsters that now find they cannot trust their land lines or cell phones.       

Give me a break, we can survive without the internet, cell phones or land lines. The telegraph can still be used, and so can the Pony Express.
