Supreme Court orders California to release tens of thousands of prison inmates

The 5-4 decision represents one of the largest prison release orders in U.S. history. The court majority says overcrowding has caused 'suffering and death.' In a sharp dissent, Justice Antonin Scalia warns 'terrible things are sure to happen.'

WASHINGTON — The Supreme Court ordered California on Monday to release tens of thousands of its prisoners to relieve overcrowding, saying that "needless suffering and death" had resulted from putting too many inmates into facilities that cannot hold them in decent conditions.

It is one of the largest prison release orders in the nation's history, and it sharply split the high court.

Justices upheld an order from a three-judge panel in California that called for releasing 38,000 to 46,000 prisoners. Since then, the state has transferred about 9,000 state inmates to county jails. As a result, the total prison population is now about 32,000 more than the capacity limit set by the panel.

Justice Anthony M. Kennedy, speaking for the majority, said California's prisons had "fallen short of minimum constitutional requirements" because of overcrowding. As many as 200 prisoners may live in gymnasium, he said, and as many as 54 prisoners share a single toilet.

Kennedy insisted that the state had no choice but to release more prisoners. The justices, however, agreed that California officials should be given more time to make the needed reductions.

Interesting, we have in New Hampshire a multi million dollar prison that is EMPTY, ---Are you listening Sparky???

The State does not have the money to man and care for anyone to be incarcerated within it, but still has to pay big bucks to maintain the empty prison.   Google the facts as I am too tired to find a link to this today.

There must be other states with empty prisons that the Feds Will not give a penny to, to put into use but still cost the state to maintain.

Private prisons are interesting, but it is interesting that those with money and influence like that Logan woman are let off with a no room at the Inn and not sent elsewhere where  there is a Vacancy sign.

So who are to be released from prison in California, a strange thought here, what would Charles Manson do if he was to be released after all these years fighting to stay in a safe place.  Would he be dragged kicking and screaming out the door, thrown into a life where everyone wants to kill him???

Are the prisoners going to be released considered low risk to the public????   Sure that is to be ignored of why they are incarcerated any way.

Perhaps that armored vest will go over big and make the seller a millionare in California, were that to happen to my area I would find a way to turn 3 of the vests into a full body suit, put bars on the windows adopt Pit Bulls and never leave my house.

Why can't we build prisons up in Alaska 200 miles away from civilisation and if the worse of the worse want to make a run for it, no problem, if the bears don't get them the flys will in the day light and the bears or the cold at night.

Numero uno, because it would be considerably more expensive to house people in even the most minimal conditions in Alaska (And of course pay enough corrections officers to live there in the land of ballpark prices for a simple grocery store beer) than it is to house them is pretty good conditions in the lower 48.

Now don't get me wrong, probably at least a third of these SOBs need to be put on a slow and very leaky ship to visit the scenic Marianas Trench, and another third deported immediately back to Mexico with "Shoot on sight" tattooed on their foreheads in case they ever try to come back.  Unfortunately, the Supremes wouldn't be on board for that.

I heard on the radio yesterday that there are over 20,000 illegal aliens housed in California prisons.  These criminals are here because the feds refuse to do their job (which they have made clear is their sole responsibility in their lawsuit against SB1070 in AZ) and protect our borders.  Now the feds are demanding that because of "overcrowding" (partly because of the 20,000+ illegals locked up) that the rights of law abiding citizens be violated.  The best thing that California could do here is tell the feds to go to hell with their release order and to come pick up the thousands of illegals who are their responsibility and have been housed by the state for all these years.
Biden is an illegitimate President.  Change my mind.
