You're right that he was originally sent as a baby. It was in 86 that things changed. I wonder if things have been changed since then. I read the "Crisis on Infinite Earths" series back in 85 that made sweeping changes to the DC universe. I know that there have been other two or three (maybe more) "crisis" stories since then that have made changes including negating some of the stuff that happened in the 85 series. I just don't know what the changes are. For all I know in the current continuity he may have arrived as a baby.

I don't think that he technically is illegal though he is an alien. I believe the capsule that he came to earth in was a gestation chamber. He was actually "born" after touching down in Kansas. Meaning he was born on US soil UNLESS they have retconned that with the several "Crisis" series they've had in the last few years.Also, although I haven't read any new comics in years I seem to remember a few years back that DC took some heat for changing "truth, justice, and the American way" into just "truth and justice." I just can't remember how far back that was.
