On ethics, he's silent, as he is on most other things. By recusing herself, Kagan demonstrates that she has a clear and active sense of ethics. It's a rare thing.

Now, if Thomas' wife or an organization in which she has a role of responsibility was to file a pleading in a SCOTUS case, it would be unethical for Thomas not to recuse himself. But short of that, there really isn't much of a case for demanding his recusal.
