Feds Threaten To Sue Arizona Sheriff In Rights Case

The county sheriff in Phoenix, known for his efforts against illegal immigrants, is refusing to cooperate in a civil rights investigation, the U.S. Justice Department said Tuesday. It threatened to sue if he refused to cooperate with the next phase of the probe.

The department has been investigating Maricopa County Sheriff Joe Arpaio's office for alleged discrimination and unconstitutional searches and seizures. Arpaio is increasingly becoming known as the Arizona sheriff who conducts random raids on places he thinks might be employing illegal immigrants.

His deputies recently raided a suburban Phoenix library at 2:30 a.m., presumably, Justice officials said, to arrest members of the janitorial staff who may have been in the country illegally.

The day after a court put on hold part of Arizona's immigration law that allowed police to ask for proof of citizenship, Arpaio announced an immigration raid that netted three dozen people, six of whom had no documentation.

In a letter, Assistant Attorney General Thomas Perez gave the sheriff's office until Aug. 17 to turn over documents first requested last year in what the department calls an inquiry into claims of discrimination based on national origin.

Somebody please explain to me why it took the DOJ 17 months to get off its ass and follow up to what it demanded at that time. Looks very much like sour grapes - Arpaio kicks some ass and takes some names, gets himself a Ma Deuce or two, and DOJ dusts off some piece of paper and threatens Arpaio with it.

Actually the explation is pretty simple.  Lord Zero wants full amnesty for the illegals so they can vote democratic.  He is hell bent on destroying this country and the more power he has at the ballot box the better from his perspective.  They feel this is their last big shot and are pushing to get over the top, all the while governing against the will of the American people.....and they frankly do not give a damn....  At this point 97% of the taxes are paid by 50% of the population.  They are that close to having more non-producing members of society who can out vote the producing members.  When that happens you had better already left the country because they will confiscate everything that is worth any kind of value.  You see BO refers to that as social justice....

Assuming Arpaio is executing warrants, those warrants should only be issued after a probable cause affadavit has been filed. All those items are public record. Arpaio doesn't need to produce them because they should be on file with the county clerk.

If his searches are based on anonymous tips the privacy of his informants should be respected but I'm not hearing this to be the case.

If he is conducting searches without warrants or reasonable suspicion of a felony in progress he needs to be pulled up hard and fast.

If his searches are based on anonymous tips the privacy of his informants should be respected but I'm not hearing this to be the case.

I would be very surprised if he is. He's been doing the gig for a very long time, has been highly controversial with all the requisite scrutiny, and I can't help but think he's got an army of lawyers who are making sure he's dotting every i and crossing every t.

Warrants and affadavits standards are lower than what most people realize. Remember the polygamy cult raid in 2008? That was due to a caller from Colorado, not Texas.

I like that Joe guy! I can't imagine him doing the wrong thing. We need more people like him and Jan Brewer standing up to the corruption in power.
