Court Rejects US Bid To Keep Drilling Moratorium (UPDATED)
« on: July 08, 2010, 05:59:36 PM »
NEW ORLEANS — A federal appeals court has rejected the U.S. government's effort to keep a six-month deepwater drilling moratorium in place.

A three-judge panel of the 5th U.S. Circuit Court of Appeals ruled soon after a Thursday afternoon hearing in a lawsuit filed by companies that oppose the drilling ban.

The moratorium was previously struck down by a lower court on June 22.

The appeals court ruling found that the Interior Department failed to show the federal government would suffer "irreparable injury" if the ban isn't restored while it appeals the lower court's decision.

Now we have to wait for this administrations new moratorium on drilling to be issued. They will keep trying to do this until at least this November.  I saw recently that Governor Crist in Florida is against drilling off the Floriduh coast. He has gone full moonbat trying to win the senate seat.

I love this statement. Why are you in this position, to judge whether or not "there's a threat of irreparable harm"? Maybe...and I'm just spitballin' here, just tossing out an idea, just a crazy thought...because you decided to become a judge?

Well, you could view the lower court ruling as boiling down to "Why is the Secretary in a position to second-guess his own expert panel and impose a moratorium?" - which would answer that question.

I saw recently that Governor Crist in Florida is against drilling off the Floriduh coast. He has gone full moonbat trying to win the senate seat.

Gov. Charlie "Oompa Loompa" Crist called for a special session (with a cost to taxpayers of approximately $40,000 a day to hold a special session)  to consider a constitutional ban on oil drilling in state waters.  One problem; offshore drilling in Florida's state waters is already banned under Florida law. He's a pinhead trying to get his name in lights for the november senate race.

Crist’s plan for offshore drilling ban met mostly with opposition

US Ready to Announce New Drilling Moratorium

http://www.moneynews.com/Economy/oil-obama-britishpetroleum/2010/07/09/id/364241

Quote
The Obama administration said on Friday it is essential that its ban on deepwater oil drilling be restored after a court struck it down and promised a revised moratorium would be announced soon.

Interior Secretary Ken Salazar told reporters in California he will make an announcement on a new ban on deepwater drilling in the "next several days."

His comments came a day after a federal court refused to reinstate the six-month ban on deepwater drilling below 500 feet, which the Obama administration imposed after BP Plc's massive oil spill in the Gulf of Mexico.

The U.S. Court of Appeals for the Fifth Circuit ruled 2-1 against the administration's request to stay a lower court decision lifting the ban, saying the government failed to show how it would be irreparably harmed if it were not granted.

The administration said it did not consider the ban a major setback for the policy because it lets the Interior Department apply to stop a project if an operator attempts to start deepwater drilling in the Gulf.

The flow of oil from BP's blown-out Macondo well is killing birds, sea turtles and dolphins, imperiling multibillion-dollar fishing and tourist industries at a time of high unemployment, and soiling the shores of all five U.S. Gulf Coast states.

The court ruling pushed shares of Transocean Ltd, the world's largest offshore drilling contractor, up more than 5 percent on the Zurich exchange on Friday. They had lost almost half their value since April.

Transocean owns the BP-leased rig that exploded in the Gulf of Mexico in April, triggering the biggest oil spill in U.S. history.

The administration said it imposed the moratorium to allow enough time for an investigation of the disaster. The energy industry fears the ban could put costly projects on hold.

Diamond Offshore Drilling Inc said on Friday it was pulling one of its deepwater rigs out of the Gulf, the first such move resulting from uncertainties surrounding the U.S. moratorium.
Not surprising to me.. They will not be denied their spoils!

U.S. Issues New Moratorium On Offshore Drilling
Quote
The Obama administration is issuing a new moratorium on deep-water offshore drilling and it's no longer based on water depth.

Interior Secretary Ken Salazar made the announcement Monday, arguing that a pause is still needed to ensure that oil and gas companies implement safety measures to reduce risks — and are prepared to handle spills.

The new moratorium will last through Nov. 30. Unlike the last moratorium, which applied to waters of more than 500 feet, the new one applies to any deep-water floating facility with drilling activities.

Last week, a federal appeals court rejected the government's effort to halt the approval of any new permits for deep-water projects and suspended drilling on 33 exploratory wells.
NPR

Why does this administration think a more  expansive moratorium will pass court muster? They really are trying to kill the economy of the Gulf Coast states.
