Attorney General Eric Holder's testimony today before the Senate Judiciary Committee demonstrates just how out of touch he is with the realities of prosecuting 9/11 terrorists in New York. Not only could the convictions of these suspected terrorists be in doubt but the public safety is now also at risk as a result of the attorney general's decision.

Holder claims that the terror suspects will not have access to highly sensitive information which could affect our national security. But that's very likely untrue. In fact, they probably will be able to see all of the information related to their trial. Holder's assertion assumes that the judge presiding over their trial will seal the information and only the lawyers will have access to it. In fact, if the terrorists decide to represent themselves they will be granted the same access that any of the attorneys have. -- This could severely compromise the safety of the United States.

It is a shame that the Obama administration is turning a blind eye to the realities of the situation. They are not only making a statement by having the trial in New York. They are putting the lives of New Yorkers, such as myself and my family, and others in this country, at risk. I disagree that Dims don't care.

I think there are probably an awful lot of the firemen, police officers, EMT's, and Port Authority people in NY and NJ...who were in there helping after 9/11 in search and rescue, or who knew someone who was lost that day...that are Democrat. As are their families.

I don't think there are many of those particular Democrats that want those animals to be given any type of trial - military vs civilian, fair, legal or anything else.

I would also venture to guess, that given the opportunity and a chance to take a gun and participate in a firing squad to shoot them.....anyone of those individuals would be standing in line.
Just hand over the chocolate...back away slowly...far away....and you won't get hurt....

Wonder what having the trial in NYC will do to NYC's tourist industry?

Not that I have a trip planned there.....but once those animals arrive in the city, I'm not sure I would want to be anywhere near there....

If I am interpreting his statement correctly, all he can do if they are acquitted is send them back to Gitmo.......if they are detained here in the US, they would be subject to Habeas writs......

Which is why it makes no sense to bring them here for trial in the first place.....

DAT...if they are acquited....can they be retried for the same crimes....or is it double jeopardy?

I know if acquited in a regular murder trial, it's double jeopardy unless new evidence is available and the charge can be changed somewhat...but does it apply in this case? They are mass murders not serial, but since they didn't actually commit the crime...I don't exactly understand how it works.

I know they can be retried... what 3 times?....if a mistrial is declared.

Double jeopardy does not apply if it is tried at a federal and if acquitted to state court. However, some states bar it.

Chuck Schumer has already asked the government for money to cover the security expense for holding the trial in NY.  It's all about money with these libtards.  So taxpayers are also paying for this trial. 

What is the point of this???  There is another motive...and I have a few guesses...but everyone, including many democrats, agree that this case should have been tried by the military.

It would be double jeopardy; a mistrial is a trial that does not go to conclusion, if this trial does go to the end then double jeopardy would prevent a retrial...by the same sovereign; technically the State could also try them, however I doubt if New York has the same tortured civilian criminal jurisdiction rationale the Feds use at its disposal.

From a very extended research project I did years ago, I can tell you it is legal under the Geneva Conventions to try an EPW for pre-capture crimes in a civilian criminal court, however there are a lot of bells and whistles involved including ICRC observers that are necessary to do that legally.  The big problem we have in trying to comply with international law doing this is that we seem to be incapable of calling them either lawful or unlawful combatants instead of just 'Combatants,' the difference between the two types of combatants makes all the difference in the world as to what kind of due process they are actually entitled to under international law - firing squad on the battlefield or full-blown due process plus extra bells and whistles.

This is just a really stupid decision.  The only reason these underwear-stripes weren't tried by a military commission years ago was Congressional whining about the commissions, which was basically driven by the desire of Congressional Democrats to purposely screw up anything Bush wanted just to count coup on him (Some of them, plus a few clueless idiots like Specter, are truly unaware there is a war on at all, and sincerely believe that all the issues in the world can be resolved by bringing suit - or charges - in a US Federal court; it is the overconfidence of ignorance, unfortunately, which is destined to eventually end badly).

Obama/ Holder stated that they would be tried, convicted and executed. The defense lawyers are going to ask for a dismissal on the grounds that these 2 amateur dunces tainted the jury pool. It will be very hard to find a juror who has not heard these two bloviating idiots. Now, the 2 jackasses are craw-fishing back into their hole saying that's not what they meant. I am concerned that this show trial will not turn out well.
