A California judge today tentatively scheduled a trial for Jan. 26, 2010, for a case that challenges Barack Obama's eligibility to be president based on questions over his qualifications under the requirements of the U.S. Constitution.

If the case actually goes to arguments before U.S. District Judge David Carter, it will be the first time the merits of the dispute have been argued in open court, according to one of the attorneys working on the issue.

Some of the lawsuits question whether he was actually born in Hawaii, as he insists. If he was born out of the country, Obama's American mother, the suits contend, was too young at the time of his birth to confer American citizenship to her son under the law at the time.

Other challenges have focused on Obama's citizenship through his father, a Kenyan subject to the jurisdiction of the United Kingdom at the time of his birth, thus making him a dual citizen. The cases contend the framers of the Constitution excluded dual citizens from qualifying as natural born.

Complicating the situation is Obama's decision to spend sums estimated over $1 million to avoid releasing a state birth certificate that would put to rest the questions.

WND has reported that among the documentation not yet available for Obama includes his kindergarten records, Punahou school records, Occidental College records, Columbia University records, Columbia thesis, Harvard Law School records, Harvard Law Review articles, scholarly articles from the University of Chicago, passport, medical records, files from his years as an Illinois state senator, his Illinois State Bar Association records, any baptism records, and his adoption records.

Frankly, this is a silly issue.  I've stated it before, I'll state it again.  Even if he was, for whatever reason, removed from office, it doesn't remove the POLICIES the Democrats are trying to jam down our throats.  The "nirthers" seem to forget that.

I agree, I think the argument that dual citizenship does not count as 'natural born' is fundamentally quite weak myself and would be a battle Obama's attorneys would willingly undertake.  There has got to be more to the fight over the BC than this, and the race descriptor is the most obvious remaining possibility.

As for the battle over college and school records, they don't disqualify him legally, but I expect they are going to show a pattern of 'Convenient' religion, citizenship, and race assertions, altering like a chameleon to do whatever was to his greatest advantage in the given situation.  Affirmative action based on race?  I'm Black!  No US citizen admission slots still open, but some left for foreign students?  I'm Kenyan!  Muslim private school is the one the upper crust attends?  I'm Muslim!

I'll go one further, DAT.  The EC actually elects the president, but the House actually tallies the votes of the individual states and declares the winner.  One item I found (wish I could link it) stated that as a procedural rule, one Senator and one Congressman could challenge the validity of the winner's eligibility.  No such challege was issued, therefore, one cannot help but treat the election of President Obama as legitimate.

I am a sane and intelligent person with an above average IQ.  I do not consider this issue silly at all.  What I find silly is accepting that Obama character as our president with absolutely no background.  It is as if the man was dropped onto earth the day he decided to enter the public political arena.  What I find "super silly" is the idea we are suppose to find questioning Obama's quaifications silly.

I'm with you and lug-nut on this one.

I think it's probably him gaming the system and/or listed as white and/or muslim on his birth certificate; neither of which would have been a game-changer in the general election (if Wright and Ayers weren't we were certain to be doomed) but now it has become an issue of, "it ain't the (non-)crime, it's the cover-up".
