Judge tosses out Stevens conviction
« on: April 07, 2009, 11:23:25 AM »
WASHINGTON - A federal judge dismissed the corruption conviction of former Sen. Ted Stevens on Tuesday and took the rare and serious step of opening a criminal investigation into prosecutors who mishandled the case.

"In nearly 25 years on the bench, I've never seen anything approaching the mishandling and misconduct that I've seen in this case," U.S. District Judge Emmet Sullivan said.

Sullivan appointed a special prosecutor to investigate Justice Department lawyers who repeatedly mishandled witnesses and withheld evidence from defense attorneys during the monthlong trial that ended with Stevens' conviction in October.

This just proves that the U.S. justice system is FUBAR.

If partisan prosecutors can do this to a member of the U.S. congress, imagine what they can do to the rest of us.

That's good for Stevens, but they still won by kicking out a republican senate seat.  They ruined the man's career.

That being said, he was as crooked as the day was long and the government didn't need to go to the level they did to prove their case.  They screwed up doubly on that one.  Stevens screwed himself by taking things he knew he wasn't entitled to under Senate ethics rules, and I for one don't want my party represented by crooks like this.

We can and must do better.

Judge orders investigation of Stevens prosecutors
Quote
WASHINGTON (AP) — A federal judge has dismissed corruption charges against former Sen. Ted Stevens and opened a criminal investigation into prosecutors who mishandled the case.

U.S. District Judge Emmet Sullivan said the misconduct was the most serious he has ever seen in nearly 25 years on the bench. He appointed attorney Henry Schulke (Shul-KEE) as special prosecutor to investigate the Justice Department team for possible criminal contempt charges.

Sullivan read a stinging summary of the many times the government withheld evidence or mishandled witnesses in the case.

They already did..........Ramos and Campeon's prosecution by Johnny Sutton showed the nation what the DoJ will do to advance an agenda.

I was prepared to consider Stevens still guilty despite the dismissal but the appointment of a special prosecutor has me reconsidering.

And Libby and Martha S.

Hoping that those Fed. prosecutors get their day in court but not going to hold my breath. Holder will shoot that down.

Prosecutorial misconduct is one of the scariest things about our legal system to me (it's right up there with crooked cops).  It must have been pretty bad in this case for this judge to open an investigation.

How many people have served or are currently serving prison sentences, or have unjust criminal records due to such conduct by over zealous prosecutors?

Chilling indeed.

He's in his eighties. What is it with these geezers to just hang on until they're buried? Drooling in the Senate chambers does not endear these guys to the voters.

More like forced him to resign.

It's nice that the republicans want to continue to take the high road, but eventually they will figure out that NICE GUYS FINISH LAST.

It's long past time for republicans to throw the kid gloves in the shredder and go on the offensive.

Republicans lost 2006 when they caved and allowed Tom DeLay to resign.

Tom Delay resigned because his fight with Travis County DA Ronnie Earle would have bankrupted him. Some facts on the "case" on Mr. Delay.

(1.) Ronnie Earl shopped 5 grand juries in Austin, Texas (4 no bills) before presenting his case before an newly empaneled grand jury (20 minutes) on the same case that the previous grand jury had no billed the day before.,

(2.) The law in which Earle indicted Delay on wasn't even on the books when Earle sought the indictment. Delay's actions on using out of state money for redistricting purposes through a state PAC was done in 2002. The law didn't pass the State legislature until 2004.

(3.) The exact same procedure of using out of state money for redistricting purposes was used in every state in the redistricting process. Nancy Pelosi, used the exact methods and procedures in Democratic efforts in California. Same with Mr Barney Frank in Mass. On the Senate side, Mr Reid, Mr Schumer and Mr. Dodd did the same thing in their respective states.,

(4.) To date, Mr. Delay still hasn't had his day in court. Mr Earle's successor in the Travis County DA office, continues to file continuances in the case in order to focus on the "people's business" on more pressing matters. and

(5.) Dick Deguerin, Delay's attorney, a Democrat, believe that the indictment is nothing short of a political lynching. He eagerly awaits his presentation in court.

Not hardly, but that apparently in West Virginia that isn't regarded as real important.
