All he has to do is send the cases to the 9th Circus and the catastrophe will be complete:

Reporting from Washington -- Accused in a 2002 grenade blast that wounded two U.S. soldiers near an Afghan market, Mohammed Jawad was sent as a youth to Guantanamo Bay. Now, under orders by President Obama, he could one day be among detainees whose fate is finally decided by a U.S. court.

But in a potential problem, Pentagon officials note that most of the evidence against Jawad comes from his own admissions. And neither he nor any other detainee at the U.S. prison at Guantanamo Bay, Cuba, was ever told about their rights against self-incrimination under U.S. law.

The Miranda warning, a fixture of American jurisprudence and staple of television cop shows, may also be one of a series of constructional hurdles standing between Obama's order to close the island prison and court trials on the mainland.

A procession of similar challenges -- secret evidence, information from foreign spy services and coerced statements -- also could spell trouble for prosecutors.

All of these problems illustrate the larger difficulty that lies ahead as the nation moves from the "law of war" orientation used by the Bush administration in dealing with detainees to the civilian legal approach preferred by Obama

This is not naivete. Obama is a full-fledged constitutional lawyer, he is totally aware of these issues. The only conceivable explanation in my mind is: if the cases are thrown-out it will be used to discredit Bush-era policies based upon the assumption that Obama's olicies are the only correct ones by which to fight terrorism.

This is worse than the Gorelick wall and it neuters the military by forcing them to act as cops rather than soldiers.

There are going to be similar issues with Abd al-Rahim al-Nashiri, of the USS Cole bombing infamy. Much of the proof against him may also be inadmissible in a US court of  law.

And what is admissable would probably be better kept secret to protect sources and methods.

We all knew it was coming, didn't we?  I foresee a 'lessened emphasis' on taking hostiles alive overseas, or on obtaining/maintaining any US physical custody of them in lieu of turning them over to their targets for 'processing' as the only sane military reactions to this folly.

Ah, I see .  I was thinking more along the lines of 0Bama wanting to withdraw from Iraq except for training and advisory personnel.

Our military would be better off from now on just shooting and killing the enemy. If they wound up in a US court, God knows the Treason Times will be there to give away all the details of the court cases including classified info on witnesses, evidence gathering, etc. Better off at this point to let God judge because if this was taken to an activist judge.... hell, they'd let Osama go with a technicality!

Whats going to happen is this;

We've now begun to move towards the point where US Servesmen'women will be more in danger in combat because they will have to read ****ing rights statements to the enemy upon capture.

The military will stop trying to go outside the wire as any instance will have to be documented to the point that it is more prudent to do nothing than something.

Commanders will be relieved because of improper paperwork on capturees, and thus, they will stop trying to capture and detain, as they know they are being flamed for it.

GIs off the streets and only in the FOBs will be attacked daily by rockets and mortars while we do nothing.

Casualties will rise, Obama will declare the war lost, and retreat.

Chaos will fill the vacum and the islamic extremists will declare victory in Afghanistan and Iraq. Iran will build its bombs and nuke Israel.

We will do nothing.

I think efforts to deal with terrorists militarily will prove untenable so Obama will resort to civilian law enforcement and diplomacy to dislodge terrorists from whatever nation they reside.
