Gov. Greg Abbott is threatening steep penalties against Texas House Democrats who fled the state to block redistricting, including removal from office.

In a statement late Sunday, Abbott said he would invoke a 2021 attorney general opinion that allows him "to remove the missing Democrats from membership in the Texas House" if they do not return to the Capitol by Monday afternoon. The House is scheduled to gavel in at 3 p.m. to consider the redrawn congressional map.

"Democrats hatched a deliberate plan not to show up for work, for the specific purpose of abdicating the duties of their office and thwarting the chamber's business," Abbott said. "That amounts to an abandonment or forfeiture of an elected state office."

I haven't had a chance to explore the issue in detail, but I'm hearing from sources I tend to trust that the Texas constitution allows the governor to vacate seats if legislators refuse to show up. Guess who gets to fill vacancies.
