So far, he's only charged with transporting illegals and conspiracy to transport illegals. I think they limited the scope of the grand jury to charges that can be independently corroborated outside of the testimony of his co-conspirators. They are going to rely heavily on the Tennessee traffic stop as proof that the co-conspirators testimony is factual. But it's enough to put him in a federal prison for a number of years and then deport him when he gets released.
