A DC judge (of course) has enjoined the President from using the Acts under the rationale that it applies to nations, not individuals.

But Lee Gelernt of the ACLU contended that Trump didn’t have the authority to use the law against a criminal gang rather than a recognized state. [The judge] Boasberg said precedent on that question seemed tricky but that the ACLU had a reasonable chance of success on those arguments, and so the order was merited.

Rubio declared the gang a terrorist organization. I don't share that opinion because - as far as my limited awareness goes - they are a strictly criminal enterprise and have no ideological motivations. However, a side of me wonders if the Maduro government gives them blessings and maybe even support to not trouble Venezuela and to afflict the hated US.

I see nothing in the language of the law that requires a state of hostilities between the US and the nation of origin of those being deported.

I wish that they were required to stay at the ruling judge's home until a hearing is held.
