My Daughter Was Fired Today

She was a log/compliance manager for a trucking company for just short of 5 years. Since the pandemic she worked remotely for over a year -- very successfully if her department's metrics are any indication. She supervised her employees (who were also working remotely) and received good performance reviews and raises, going from hourly to salary. She and her husband (who is an owner/operator for the same company) bought a farm about 2 hours away, with the company's knowledge. She's been living there since last September, doing her job and functioning just fine.

Fast forward to last November, when her employer hired a new safety manager. He came from a large trucking company to "reorganize" and help the company improve its metrics with FMCSA (they are currently undergoing an audit). Based on some of the conversations she's shared with me, the guy is a Grade A misogynist. He basically treated her like his personal admin assistant. He abhors technology, doesn't like virtual meetings and said he hated remote workers because you couldn't trust anyone who wasn't in the office (where he could watch them). He posted a position on the company's website (which contained a lot of her job duties). When he asked him if she needed to "interview" for it, he said he "wouldn't consider giving her an interview unless she came back into the office."

He announced 2 weeks ago that EVERYONE was coming back into the office on March 1st. She made arrangements to move back to her house here. She's been coming up to the office every Wednesday for in-person meetings preparatory to returning, and he's been giving her lists of tasks to finish in anticipation of that.

Today, he and the head of Human Resources called her and fired her. When she asked why this was happening given that she was coming back into the office per his request, he said he was "downsizing" her department and didn't want her to have to find a new place to live (I guess forgetting she told him she had a house here). He said she wasn't being fired "for cause," they wouldn't dispute unemployment and would give her severance and paid vacation.

She is gutted. I'm wondering if anything is actionable, given that KS is a right-to-fire state.

I want to punch this snake right in the throat. She says he pretty much fired her because he didn't like her and I don't know what to say other than "I'm sorry."


Ok, that sure sounds like the SAFETY MAN is running things, right?  I remembered reading a thread over there awhile back about one of the DUmmies coming out of retirement and ... he went to a TRUCKING COMPANY to be a SAFETY MAN.  Look at this.

Coming out of retirement was much more exciting than I thought it would be

I posted awhile back that I had returned to work for a year at my former employers request to help deal with safety issues that weren't getting resolved at a trucking company he bought. When I got there it was worse than I thought, there were many problems from safety equipment and fail safes missing from trucks to loads being thousands of pounds overweight, they even had planned routes through back roads to avoid weigh stations. I released a memo of all the changes we would be making and got a letter signed by the majority of management saying the company couldn't operate this way and would lose money, they also told me something I didn't know, without the hacked version of the electronic logging devices they couldn't make their deadlines. This means they were running drivers over their hours, tired drivers pushing overloaded trucks. To say I was shocked and mad would be a real understatement plus they admitted breaking the law!

I sent the letter to my boss and he hit the roof, the entire management team is gone, he is also doing a full audit since operating under reasonable safety rules is entirely possible. At this point I am running the company as he sends in people to help. My position has switched to trying to keep this place together and help the new management rebuild focusing on safety, I got a nice bonus and raise for the rest of my year. This isn't exactly what I was expecting, I don't have the background for it being a former truck driver, but it is challenging and only for 11 more months, then I can go back to being retired.

I'm well aware that regulocrats and insurance companies do periodic audits, and that companies sometimes hire outside companies to do, "How are we doing?" audits. But if all is well, companies don't hire outsiders to "improve their metrics". I think the audit found a very significant problem.

So either the audit found a significant problem for which rustysgurl's daughter was responsible or had failed to fix, or rustysgurl's daughter was found to have not logged in to do remote work when she claimed she had (companies have done occasional audits of remote log-ins for over a decade, Yahoo! being a company - in 2011, IIRC - that found employees claimed work-at-home days in which the employees had not even logged in). Or both. Maybe daughter was sloughing and was responsible for a problem (or didn't fix one).

This chicks husband is an owner/operator for the same company. I'm curious to know how that will change the dynamic between those two.

The husband and his honey also have a farm 2 hours from HQ. I would guess this separation is going to free up time for feeding the livestock and harvesting the hay. Total win-win.

This chicks husband is an owner/operator for the same company. I'm curious to know how that will change the dynamic between those two.

The husband and his honey also have a farm 2 hours from HQ. I would guess this separation is going to free up time for feeding the livestock and harvesting the hay. Total win-win.

I forgot about that when I posted above. A third possibility is that she and hubby pulled some shenanigans with hubby's logs.

Several people in my company, including little old me, live an hour+ away and in different states from the mothership. Company doesn't care, as long as you show up when needed, why would they care?

Also it is pointed out that the kids apparently kept their old homestead as she was apparently moving back to be closer to the office. In November the company started wanting employees to get into the office, this was the perfect opportunity for her to show she could be there everyday. One could speculate that the real problem is right here, she simply wanted to continue working from home and gave the excuse that she was living high on a pot farm 2  hours distant and that was that.

To another point, if one of my kids were to be canned from their job, I cannot imagine the first thing I would do is tell everyone on dumbsh*t underground about it.

Unless the next step was applying for SSDI or other freebies then I would be consulting the experts at DUmmie underground.

I think their line of thinking goes more like this;

1.  Get a lawyer!  Sue!  Sue!  Sue!
2.  File for unemployment so you can hold out for your SSDI approval.
3.  File for SSDI
4.  Go looking for a new home and tell the agent "I'm waiting on a settlement."

It's a trucking business. Owner/operator probably refers to her hubby owning his own truck, not the company.
