As I have noted in other recent posts, much of the recent ‘news’ about the insurrection has not been terribly new. It’s repackaged versions of things we knew or additional evidence and detail. This story published last night in the Post is one of the biggest revelations I’ve seen to date. John Eastman is the Federalist Society right wing law professor who wrote up the legal gloss for the President’s coup plot. It created the connective tissue joining the coup plot within the government with the paramilitary violence that broke out on Capitol Hill on January 6th.

The Post has emails – presumably emerging out of the committee investigation – of what happened during the insurrection. As the insurrectionists were storming the Capitol and Pence was holed up in a secure location as they hunted for him and members of Congress, Eastman emailed Pence and his top aide saying that the insurrection was Pence’s fault for not going through with the coup plot. With the President’s supporters ransacking the Capitol Eastman demanded Pence shift course and do the right thing.

These exchanges capture something we suspect and know in some way. But here we’re getting the details, the documentary evidence. Eastman didn’t recoil when the President’s rally escalated to violence. He clearly saw the inside coup plot and the insurrectionists on the street as part of the same effort. This isn’t surprising to most of us. The insurrectionists were laying siege to Pence in the Capitol because Pence wasn’t going along with the plan. And the answer was to go along with the plan. Eastman recognized the insurrection as the paramilitary wing of the coup plot he was part of and as the Capitol was under siege used it as a cudgel to force Pence’s hand.

Again, this won’t come to a shock to many of us. But here we’re getting the receipts. At least the first of them. To date the actions of Eastman, the President, his various coconspirators – during the hours of the assault on the Capitol – have largely been a black box even as we’ve learned more and more granular detail of the ransacking of the Capitol itself. We’ve had brief glimpses in reported accounts. There was the notorious phone call between Minority Leader Kevin McCarthy and Trump in which McCarthy demanded Trump call off his insurrectionists. Trump notoriously responded, “Well, Kevin, I guess these people are more upset about the election than you are.”



I can't how we can just let this slide. It's so disgusting and criminal and has to be prosecuted.

2. Does this also indicate that Pence had previously agreed to take part in the plot?

That sounds to me like Eastman thought Pence had agreed to do his part but then backed out. No wonder he wouldn't get into that car. I'd be pretty wary of what they might do to me also, especially if they thought Pence had turned on them.

7. Didn't Pence make a speech indicating that he would go along with it?

Something about he wanted to see justice done or the process was going to be carried out and everything resolved satisfactorily if I remember right. it sure sounded like he was with them and the Audience thought so too and cheered. Had this look on his face like, “I got this” to mollify the base until it was too late.

8. Let's see what we got here

We got a bunch of people including Trump wanting to stop Pence from counting and certifying the electoral votes as required by law and the US Constitution.

These people, who were plotting to stop the legal execution of constitutional requirements, should have loyalty to the US Constitution because many of them took oaths saying just that.

They plotted to use the crowd of protesters to stop and/or murder Pence.

Seems to me we have all the elements of Treason under the Constitution as Levying War against the United States.

Keep digging up facts and documenting what these traitors did because there is no statute of limitations on Treason. Maybe years from now, someone will gain a backbone and file charges against these traitors. They will always have these charges hanging over their heads. All of them from Trump to Miller to the federalist society, will have these charges waiting for one brave prosecutor.

There doesn't appear to be anything in what we've seen from Eastman to this point (including this link or the WP article) - that has any suggestion of foreknowledge of a 'paramilitary wing' or a storming of the capital. Rather than a paramilitary action Eastman's scheme was predicated on something more like a parliamentary maneuver. The problem has always been (and remains) to draw a substantive link between Eastman (and/or other WH players and schemes) and the actual storming of the Capital. And this material, despite assertions like made in the clip above, does not provide that.

Source not identified, fact-checking not possible. "Emails"' texts not quoted in full, fact-checking TPM's claim against the "emails" not possible.
