It's hard to imagine that Kennedy and Ginsburg can hold out, or want to hold out, for 3 more years. I'm desperately hoping they can/will, but it seems unlikely. It's just so sad that everything we baby boomers fought so hard for, especially choice, will very possibly be completely dismantled in the near future.

If the worst happens and the court goes hard right for a generation, or two, perhaps we can combat it with legislation. But this 100% depends on taking back the House and Senate. Praying for the best case scenario, but very, very concerned.

MoonRiver - I'm also a boomer and I recently posted a blog entry in which I recounted all the advances flowing from the New Deal and the Warren Court. Republicans, I concluded, are hoping to reverse all of that, accomplishing judicially what they can't accomplish legislatively. That this should result, in large part, through votes cast by working class men and women would have been unimaginable when we were growing up.

With each passing day with the House and Senate propping up Putinism Western Division, they are looking less and less like the bodies as described in Article I of the Constitution and thus have no legitimacy.

This is looking like this might be the only way to save the court.

We have 7 1/2 more years, with a bit of luck we will get 3 or more conservatives on the bench. You all are worried about legislating from the bench, but I guess it is ok when it comes from all the liberal / progressive judges around the country pushing their agenda from the bench. :argh: :argh: :argh: :argh: :argh:

Ruh-Rohhhhhh, Raggy! Somebody just woke up to reality. Note well, how (s)he regards Kennedy as a liberal. He is more of a fence-sitter or weather vane, but pointed the Lib/Prog way fairly often. OTOH, I don't think Kennedy perceives a need to keep the Trump-Barbarians out of the US Supreme Court the way Ginsburg probably does.

My groundless speculation is that Kennedy will resign fairly soon, well within Trump's first term so the Ds can't invoke the Biden Rule, but Ginsburg might hold out till the day she dies or a D is elected President, whichever comes first. If she holds out to the 2020 election and if Trump is reelected, that discouragement might result in her dying within a few weeks. I think it would be better for her and for her family if she resigned fairly soon - politics entirely aside - but I doubt she sees things that apolitically.

With Kennedy, I think he may have just been willing to let the chips fall where they may on his own retirement, without worrying about who would appoint his successor.  Ginsburg, on the other hand, I'm pretty sure believed the polls and expected Hitlery to appoint her turtle and so held off her own retirement.  Muahahahahahaaha, Ruthie!

Will this be announced on CNN and MSNBC?  I do not recall anything in the constitution regarding declaring duly elected bodies of Congress illegitimate. So one is left to assume that you are talking about overthrowing the legitimate legislative branch of the US government.

didn't retire early in Obama's terms(s) as a tactical move, just to allow Obama to appoint decent judges to replace them. I mean, if you are 75 or 80, why not retire a few years before you really want to, especially if it means non-crazy judges replace you?
