California's largest state workers union filed two challenges Friday to Gov. Arnold Schwarzenegger's order to lay off thousands of workers and drastically reduce the pay of most other state employees to save cash during the budget impasse.

The Service Employees International Union Local 1000, which represents about 94,000 workers, filed a lawsuit in Sacramento County Superior Court claiming the governor's move to lay off 10,300 temporary employees is unlawful. The lawsuit demands that laid-off workers be reinstated with back pay.

"We think that it is beyond his authority to be issuing an executive order that lays off thousands of state workers by an executive fiat. That's not his role as the governor," said Brooke Pierman, an attorney for the union.

I give 75% odds the Governor will win.

Temp workers are at-will workers with no protection -- not even Union Protection. I am willing to wager that the case will get tossed for lack of standing.  And if that doesn't happen, the Governor, as Chief Administrator, will be found to have authority to do exactly what he did.

I know you can file a motion of dismissal, but someone needs to file a lawsuit against a lawsuit to prove the point that running to court is not the answer to everything.   I mean this to be towards separation of powers issues.  

This suit appears to be asking the court to step on the governor's powers.  It is getting ridiculous.  If the governor has the power to make such decisions, then he has it, and he derives it from an established source.  What is reasonable about running to the court to try to undermine the governor's authority when the court has no such power?

There is never an appropriate time.   California has been a shithole for generations.  Parts are beautiful but the ruling elite have made it hell.

And on top of there never being a right time, I'm going to bet that the CBA (Collective Bargaining Agreement) has a no strike policy in it......................ie, you strike, you're fired. So please strike now

 All my Government (State) friends are accecepting the fact that they will be making less than $7.00 an hour (Their unions and higher ups have told them dont hold your breath on this either) :rotf:
