My secret lawyer decoder ring tells me Fajin is just a BS artist.  In the very rare situation that a client wanted a written legal opinion ex any other representational involvement in a situation, the normal arrangement would be pay in advance for a given number of hours and then an agreement to pay any necessary additional hourly fees up to an agreed maximum (At which point the attorney would turn it over to a summer intern or paralegal to do all the gruntwork and then bill the whole thing at the 'Attorney' rate after putting in about an hour of actually checking the work).  A $3500 retainer is a litigation-size retainer for either a complex case or a client you really want to go away.
