Which is interesting since Schmucky Schumer wanted an embargo on any new SC appointees during the last 19 months of the Bush Administration.

Cruz has vowed to filibuster any nominee that makes it out of committee.  Lets hope Grassley doesn't let a nomination out for a vote on the floor.

This may all ready have been posted somewhere and I try to stay far away from conspiracy theories but I would not be surprised if there isn`t a push going on right now in some circles for Justices Ginsburg and Breyer or Souter to retire so as to leave the court decimated and more likely to have nominations considered.

There has been talk about Ginsberg retiring come the end of the current SCOTUS calendar in June.

That would actually take some of the pressure off the senate to confirm a nominee.

It would deflect the media for about one nanosecond. Oh, no, the media have a laser probe on the Scalia thing. They're like pit bulls -- won't let go of it.

I meant that the senate wouldn't have to worry about 4-4 ties if there  are only 7 justices. Screw the MSM.

Simple solution: Congress should pass an eight justices amendment.
No need for a ninth.

The Constitution gives Congress the power to decide how many seats there are on the Supreme Court. In 1789, there were only six.

Congress could reduce the number of Supreme Court justices from the current nine to eight.

There has been as many as ten.

The most recent thing I could find about an 8 member USSC being tied would result in the lower court ruling standing, not being sent back for them to review.

As long as there exists an extremely ****ed up lower court like the 9th Circus court, there needs to be a way to overturn their rulings.
