House GOP Can Pursue Obamacare Lawsuit, Judge Says House ReÂpubÂlicÂans can purÂsue their lawÂsuit against the Obama adÂminÂisÂtraÂtion over its imÂpleÂmentÂaÂtion of the AfÂfordÂable Care Act, a fedÂerÂal court said WedÂnesÂday.
Judge RoseÂmary CollyÂer of the U.S. DisÂtrict Court for the DisÂtrict of Columbia said the House has legÂal standÂing to sue the adÂminÂisÂtraÂtion over the way it funÂded one of the health care law’s subÂsidies.
The rulÂing is a sigÂniÂficÂant setÂback for the White House, which had tried to get the House ReÂpubÂlicÂans’ lawÂsuit disÂmissed, arÂguing that the chalÂlengers were askÂing the courts to settle a simple politÂicÂal disÂpute.
House ReÂpubÂlicÂans auÂthorÂized the legÂal chalÂlenge on beÂhalf of the House as an inÂstiÂtuÂtion, arÂguing that the adÂminÂisÂtraÂtion acÂted ilÂlegÂally when it funÂded the health care law’s cost-sharÂing subÂsidies, even though ConÂgress had not apÂproÂpriÂated money for the proÂgram.
