Civil Rights Argument Made in Court Over Criminal Code 182.5

just a rememinder:

CAL. PEN. CODE § 182.5
Notwithstanding subdivisions (a) or (b) of Section 182, any person who actively participates in any criminal street gang, as defined in subdivision (f) of Section 186.22, with knowledge that its members engage in or have engaged in a pattern of criminal gang activity, as defined in subdivision (e) of Section 186.22, and who willfully promotes, furthers, assists, or benefits from any felonious criminal conduct by members of that gang is guilty of conspiracy to commit that felony and may be punished as specified in subdivision (a) of Section 182.

So- if you are an active part of a criminal gang and know that it has committed crimes and you benefit, promote, or assists that felony you can be charged with conspiracy to commit felony.

Seems pretty straight forward.

This is one of those critical cases that matters. The ACLU got involved when Brandon Duncan was still involved since that was easy. He is a rapper, a father, has no record, and is pretty clean cut.. I wonder if they will again. Yeah, yeah people flashing gang signs and guns might not be your or my cup of tea, but it is speech. So be it. Yeah I rethought the headline... So the link is that it is.

Anyhoo, while proximally this is a San Diego Story, and a California story criminalizing gang membership and gang speech has happened in other states as well, New Jersey comes to mind. So these are the kinds of cases, many folks don't pay attention to, where crazy legal theories are tested. Those same crazy theories will be tested on nice white middle class people in a generation.

Take my words on this, the DA is not too happy we are following this case, nor does she realize the hornet's nest she kicked with the AA community.

Do you ever stop and think what the **** do these Bloods and Crips think of a midget Mexian Russian balding white jewish woman waddling around asking about gansta rap and shit?

At least I am pretty sure she won't be raped.

2. You welcome

I am one tired one, and Tom did a 48 shift, no I am serious on that one. I intend to relax over the weekend, and he'd better get some sleep.

4. The continuance this mornig was nuts

it was scheduled at 9... the technical mistake was they did not have one of the suspects on the transport list, or rather for the same date in 2018. So oopsie, they had to go get him. Once the judge started it was done in an hour.

13. You are correct and in a conversation with one of the defense attorneys we made that case, so we could understand CALGang better, we used lawyers instead of cops. The DA staff was behind us on the stairs going down for lunch. They were not amused. The defense lawyer patiently explained the DIJ and CALGangs to us.

That was in March 16. I have done far more reading into all this than it is sane... and on a more general level I think I will read Race Matters by Cornell West this weekend. I got a used copy at Goodwill, and now it is on my stack. For a change it is a paper book.

We all could be dragged, ultimately And as far as police is concerned, could be interesting.

Here is something to know about this. It never made it out of committee in the legislature. They could not pass it. So they put in Prop 21 in 2000... since we the voters would be too scared of the gangs, and vote for it.

WTF is she talking about? That entire post makes absolutely no sense.

There were only two options for gender. At last count there are at least 12, according to libs. By that standard, I'm a male lesbian.

Nothing to add here. Yeah, yeah I’m just wasting space.

Anyhoo, I wanted to flash a Hi-5 gang sign to dutch, for bringing all of this nad wisdom, over.

Maybe it's different in Tijuana and Ensenada, like P de F- which really throws her off when she uses one of our Anglo computers.

Or maybe Mexican police are not permitted to unionize.

Whith all the cruchy news I have to follow, I find I don't have as much, to waist on teh NADIN, as I wonce... haz time wize.

What with all the weather warnings, police scanner calls, and Argle Bargle, small parrot behavior issue research, which books I have added to the stack, I find my time full.

We are expecting up to 60 cm of ice and snow with projected amounts around 5 to 6 inches. I put the friend who is a girl on 48 hour watch in the just in case mode- if the gangs don't rise up #ganglivesmatter and riot the feed store the calves should be fine.

But you should all know this anyway.

Well now, I'm somewhat concerned myself. After reading his last post I think you may be right about dutch. He's either a linguistic genius who's as fluent in the nadinese as nadin herself or he actually is nadin. If it is the latter I have to wonder how he creates her public appearances. Has he created some sort of 5' tall Weeble automaton or is he using some sort of holographic projector?

Regardless, good job, dutch.

So they put in Prop 21 in 2000... since we the voters would be too scared of the gangs, and vote for it.

California Proposition 21 (2000)
From Wikipedia, the free encyclopedia
Quote
California Proposition 21, known also as Prop 21, was a proposition proposed and passed in 2000 that increased a variety of criminal penalties for crimes committed by youth and incorporated many youth offenders into the adult criminal justice system. Major provisions of the proposition, as summarized by Attorney General of California are:

* Increased punishment for gang-related felonies; death penalty for gang-related murder; indeterminate life sentences for home-invasion robbery, carjacking, witness intimidation and drive-by shootings; and a new crime of recruiting for gang activities; and authorizes wiretapping for gang activities.

* Requires adult trial for juveniles 14 or older charged with murder or specified sex offenses. Invalidated by the state Court of Appeal in San Diego in early 2001)

* Elimination of informal probation for juveniles committing felonies.

* Required registration for gang related offenses.

* Designation of additional crimes as violent and serious felonies, thereby making offenders subject to longer sentences.

Prop 21 was only partly aimed at gangs, and to the extent it was, it was focused on gangs' violent criminal activities. It was passed 62% - 38%, so nads' scared-the-voters narrative is pretty silly.

CA's constitution provided a means for voters to bypass the legislature and governor when they wouldn't do their job by addressing the needs and concerns of the people of CA. CA's voters do sometimes get fooled by well-funded campaign advertising, but Prop 21 wasn't one of those instances.
If The Vaccine is deadly as anti-Covid-vaxxers claim, millions now living would have died.

I still say she ought to join forces with that Asher Bunch-of-letters kid. He could take some of the heat off of her so she could nadin correct info.

Nothing passes in California unless it's favored by left-fringe moonbats, because left-fringe moonbats make up a significant majority of the California electorate. They are as batshit crazy as Massholes and Chicagoans.

So the far left agrees with normal people when it comes to putting as many young 0bamaite males in prison as possible, at least in California, where they don't need those extra democrat votes.

San Diego has a larger problem with Latino gangbangers than with the Blacks.  You'd think she'd be posting her garbage in the DU Latino forum too, but I guess she just wants to be on the black lives matter bandwagon.
