Civil Rights Argument Made in Court Over Criminal Code 182.5

just a rememinder:

CAL. PEN. CODE § 182.5
Notwithstanding subdivisions (a) or (b) of Section 182, any person who actively participates in any criminal street gang, as defined in subdivision (f) of Section 186.22, with knowledge that its members engage in or have engaged in a pattern of criminal gang activity, as defined in subdivision (e) of Section 186.22, and who willfully promotes, furthers, assists, or benefits from any felonious criminal conduct by members of that gang is guilty of conspiracy to commit that felony and may be punished as specified in subdivision (a) of Section 182.

So- if you are an active part of a criminal gang and know that it has committed crimes and you benefit, promote, or assists that felony you can be charged with conspiracy to commit felony.

Seems pretty straight forward.

This is one of those critical cases that matters. The ACLU got involved when Brandon Duncan was still involved since that was easy. He is a rapper, a father, has no record, and is pretty clean cut.. I wonder if they will again. Yeah, yeah people flashing gang signs and guns might not be your or my cup of tea, but it is speech. So be it. Yeah I rethought the headline... So the link is that it is.

Anyhoo, while proximally this is a San Diego Story, and a California story criminalizing gang membership and gang speech has happened in other states as well, New Jersey comes to mind. So these are the kinds of cases, many folks don't pay attention to, where crazy legal theories are tested. Those same crazy theories will be tested on nice white middle class people in a generation.

Take my words on this, the DA is not too happy we are following this case, nor does she realize the hornet's nest she kicked with the AA community.

it was scheduled at 9... the technical mistake was they did not have one of the suspects on the transport list, or rather for the same date in 2018. So oopsie, they had to go get him. Once the judge started it was done in an hour.

13. You are correct and in a conversation with one of the defense attorneys we made that case, so we could understand CALGang better, we used lawyers instead of cops. The DA staff was behind us on the stairs going down for lunch. They were not amused. The defense lawyer patiently explained the DIJ and CALGangs to us.

That was in March 16. I have done far more reading into all this than it is sane... and on a more general level I think I will read Race Matters by Cornell West this weekend. I got a used copy at Goodwill, and now it is on my stack. For a change it is a paper book.

We all could be dragged, ultimately And as far as police is concerned, could be interesting.

Here is something to know about this. It never made it out of committee in the legislature. They could not pass it. So they put in Prop 21 in 2000... since we the voters would be too scared of the gangs, and vote for it.

We are expecting up to 60 cm of ice and snow with projected amounts around 5 to 6 inches. I put the friend who is a girl on 48 hour watch in the just in case mode- if the gangs don't rise up #ganglivesmatter and riot the feed store the calves should be fine.

Well now, I'm somewhat concerned myself. After reading his last post I think you may be right about dutch.
