May 2, 2015 (San Diego) San Diego Police released the name of the officer and the person who died in an officer involved shooting early last thurday. The officer is 27 year veteran of the force Neal N Bowder. The person who died was identified as Fridoon Zalberg Rawshannehad, 42 from San Diego.

According to reporting by NBC Officer Bowder did not have his body camera on when the encounter behind a dark alley occurred. This encounter was at the 3200 block of Hancock street.

This raises multiple questions since thre is no tape of the encounter. There is leeway in the policy if an officer is ambushed, but this appears to be the case. So at this point, we do not know if policy was violated, or what actually led to the lethal encounter.

From other media reporting we know that the store clerk called 911, and according to police officials Rawshannehad advanced towards the officer with a knife and refused to obey commands. The investigation is still ongoing.

Analysis
In our coverage of the issue of body cameras, one of the problem is how strong the policy is. The Department has this in it’s policies:

Officer Safety takes Precedence over Recording Events

Quote
Officers shall follow existing officer safety policies when conducting enforcement stops as outlined in Department policies and procedures. Officer safety shall be the primary consideration when contacting citizens or conducting vehicle stops, not the ability to record an event.

This incident, it appears, did not have the component of an enforcement stop. The officer we would presume had time to turn the camera on, to stop the 30 second buffering and record the whole encounter. The department could very well discipline the officer, including termination.

Moreover, from the department policy we also learn this:

Accessing, copying, forwarding or releasing any digital evidence for other than official law enforcement use and contrary to this procedure is strictly prohibited. Public release of digital evidence is prohibited unless approved by the Chief of Police or their designee.
We do not have any video of the event, since they have said none exit, at least not from the body cam. This development will test the department, both in internal policies, and also might point to a need to change policy.
