I'm sure there's a charge sheet floating around on him. I haven't been following it, but it they did an Article 32 investigation, charges would have been preferred first. However, I believe the investigation that they refer to is not the UCMJ Article 32 one, but an administrative investigation under AR 15-6.
Technically, the Pentaweenies can hide behind the fact that charges, even if already preferred, have not been referred to a court-martial right up until that final step happens. You really can't take anything coming out of the five-sided funhouse at face value, there are always a lot of very particular jargon usages and highly-technical distinctions involved in their seemingly-straightforward press releases.
