Obama's recess appointments bet sours

Another ****ing case of IOKIYAR???! I seem to remember a few Bush recess appointees like...John Bolton!!

While the president surely suffered an unexpectedly bad result, the D.C. Circuit’s opinion Friday is far from the last word on the subject. The administration could ask the full bench of the appeals court to take up the case. The Justice Department could also try to take the case to the Supreme Court.
Several lawyers said Friday that one of Obama’s best hopes at the moment is that the very expansiveness of the D.C. Circuit’s decision will undermine it.
“If this ruling is upheld, as a practical matter, it will negate the president’s recess appointment power. He won’t have it any more,” said one prominent D.C. lawyer who asked not to be named to avoid complicating cases handled by his law firm. “It really is a big deal.”

And the problem with 0bama not having the power to do recess appointments is?
The DUmmies howled when Bush did it, and I hated it when he did it, but he never did it when congress was still in session. I think that no president should have that power unless it is a major emergency, but even then if there is a vacant spot there is always a second in command that can act in that position until the Senate can confirm a replacement.

Waiting until Congress is not in session makes all the difference.   :rotf:  Poor little DUmmies, even Pres. O is subject to the law.   :lmao:

Someone needs to tell him that.

What I think is going to happen is the SC is going to put this off and by the time it gets heard 0bama will be out of office, and the defense will be, "At this point in time, what difference does it make?".

Is he?  I've not seen evidence to support that supposition.  Is Holder still a free man?

I am still incensed by the fact that Holder was found in contempt of congress, the only time that has happened in American history, and NOTHING was done about it.  That's just about the height of hubris in my book.

As Hillary says, at this point in time, what difference does it make? Does it matter if those guns were given to them by our government, or by 2 people out for a walk in the middle of the night?

Agree completely.  If such isn't the case, why keep the Asst./2nd around?  There is nothing that happens that cannot wait for Congress to reassemble in session.

The House has a civil suit pending.

It's not the only time. Contempt of Congress (Wikipedia) (http://en.wikipedia.org/wiki/Contempt_of_Congress).

It's not the only time. Contempt of Congress (Wikipedia) (http://en.wikipedia.org/wiki/Contempt_of_Congress).
Lists fourteen (including Holder), since 1975.
Perhaps justaguy only considers 2008 to be the start of American history.  :whistling:

It irks me that this case was brought to court by a "civilian" and not a GOP member of congress.  Congress took no action regarding the illegal appointments AFAIK.

I took Fox News at their word:

no attorney general has ever been held in contempt before by the full House.

And when W did it...Congress was really out of session.

President Bush made 29 recess appointments when the Senate was adjourned for 14 days or less—including John Bolton, the controversial US Ambassador to the United Nations, who was blocked by Senate Democrats. ("It's the wrong thing to do," said then-Sen. Barack Obama, D-Ill., about Bush's move. Things always look a lot different from the other end of Pennsylvania Avenue.)

No mention of AG.
New improved statement.

So.. uh... unless I'm mistaken... it's the only time.
Since when would an AG be exempt?
So what if the idiot is the first AG to be held in contempt.
He earned it, and you know it.
You're back-peddling and grasping.

Holder is still free, for now, but he is practically irrelevant.  An exposed crook on a downward spiral who got pwned by a kid:

Quote
Attorney General Eric Holder testified before the House Judiciary Committee on June 7th. During that testimony, Rep. King asked him about the video the Project Veritas released in April.

http://www.theprojectveritas.org/node/116

Quote
Project Veritas also paid a visit to Attorney General Eric Holder's home to see if the nation's top enforcer of gun restrictions would be willing to place a sign in front of his home that read, "This home is proudly gun free!"
http://www.theprojectveritas.org/node/152

Holder, if you want to sell guns, go open a gun shop or become an arms dealer.  You've got no business being AG, it's time to resign.
