We can't even keep the people we convict to two life sentences in jail without being released early, so no the death penalty is defiantly off the table. It becomes a possibility if the feds prosecute though.

Seeing that the FBI is the lead agency in the investigation, I'd say that the possibility of the Feds going for the DP is somewhere north of 150%.

McVeigh, I think.  But, right now, it sounds like Suspect #2 just may get his death sentence carried out by the Massachusetts State Police.  Good.
