$190k seized because brothers were "drug suspects" city refuses to return money

in spite of court order forcing return

Two brothers who say police unlawfully seized more than $190,000 from them during a traffic stop had been under surveillance and were suspected of drug-dealing, a lawyer for the city of Aurora said today during a court hearing.

Though neither Jose nor Jesus Martinez is charged with a crime, authorities are seeking forfeiture of $190,040 found in Jesus' truck when he was stopped by an Aurora police officer on Oct. 18.

A Kane County judge ordered the money returned, but the city has refused.

The Aurora residents claim the money was family savings earned from a remodeling business. But during the hearing, an attorney disclosed reports from an Illinois State Police drug task force saying police had received court permission to tap the brothers' phones on the suspicion they were involved in drug trafficking.

1. Innocent until proved guilty......Right....

America is not even close to the country it represents itself as..No trial, no verdict , yet punishment is applied...This is the Bush* doctrine all over again. If we even suspect someone of thinking of doing wrong we can go all out against them without warrant or due process. And Bush* and Cheney still strut around bragging about they made America safe..

HIMMMMM I do remember the story about the 80 year old woman that allowed her 25 year old grandson to move in until he got a job.

2 years later the police showed up, at the door.  The grandson was growing pot in his bedroom ----kept locked from grandma,  and the plants grew so big they could be seen from the outside.

The old lady had her home taken from her as she was "allowing" drugs to be grown on her property.

Then the Elderly Italian woman that had a good size plot for a veggie garden.  The police came when the plants were about a foot high and tore everything up and arrested her for growing pot----The plants in question turned out to be Eggplant

Then the puzzle of an interesting event in this area that no one could make heads or tales out of.

Some minor criminal, not wanted at the time, goes into a phone Booth' this was a few years ago---and found an envelope, a good sized one behind the door.  He picked it up, took it home and found over $200,000 in valid $100.00 bills.

He goes on a spending spree, bought his friends what ever they wanted.  Someone that he did not give money to dropped a dime and called the cops.

The poor man was arrested for grand theft BUT, no one had come forward to claim the money.  He had only given away about $8,.000 and the rest confiscated.

People became a bit curious about all this but the police and courts would not say a word---Some kind of gag order on everyone.

After about 6 weeks of the citizens demanding information a press release was put out that the owners of the money had put in a theft report.  The owners were not identified by name only as foreign business men.

The poor slob took his lawyers advice and went for a trial by judge with no jury and ended up in jail for 2 years.

It was only by word of mouth that we found out the money was in a phone booth down by the loading, unloading docks..    HIMMMMM.

Is it true that when boarding a plane for another country if you are caught with $5,000 cash on you, you will have alot of explaining to do ????

Yeah happens to me on a weekly basis.  :lmao:

I've heard that if you get caught with a certain amount of cash or more (I forget the amount) that they can confiscate it without cause.

In one of the deepest blue (& by that I mean corrupt) states.
When you are the beneficiary of someone’s kindness and generosity, it produces a sense of gratitude and community.

When you are the beneficiary of a policy that steals from someone and gives it to you in return for your vote, it produces a sense of entitlement and dependency.
