A Brooklyn girl who claims her high-school softball coach told her to "take it like a man" when she injured a finger during practice now wants to hit the city where it hurts -- in the wallet.

Lincoln HS junior Rebecca Sacerio, 16, of Coney Island, is suing the Department of Education for $5 million.

She claims to have suffered permanent damage while taking part in the five-hour session with a right index finger broken in three places.

Her mother, Paula, applied ice and gave her Tylenol, but two days passed with no improvement. Finally, a specialist told her she needed surgery.

Mom obviously didn't think it was a big deal when she first saw it or she would have taken her to the e.r. -- this is utter nonsense.

Mom's health insurance should cover a broken finger.  Everything else is bullshit.

Nope--sorry, mommy didn't show due diligence.  Had she taken her sweet little princess to the ER immediately, she might have a case.

Now all the little angel has is a broken finger and will likely be laughed out of court.  The coach, OTOH, probably feels like a total shithell.

My brother was the pitcher on our little league team and got nailed in the face after he pitched a fastball to the hitter. 

He sat out for the rest of the game but my parents didn't sue the coach for eleventy billion dollars over it.

I can see where the coach is coming from--she does kinda look like Joba's brother.

Some of the comments are priceless...and one is dead on.  9/11 first responders are getting $12K and she and her mommy want $5 Mil?  Yeah, don't see that happening.

I'll admit, the first time I broke my arm, it took two days for my mom to take me to the doctor.  It didn't swell, so she assumed it couldn't be broken.  However, I didn't try to sue my school over it.  It only took her one day to take me the next time I broke it  :rotf:

The same kind of thing happened to a friend of mine when we were in junior high. She jammed her finger when a basketball was thrown to her. But she didn't jam it. The male coach told her to suck it up, and he actually tried to pull out the jam. Well it was a broken finger, and he did make it worse with his pulling. BUT funny thing is there was no lawsuit. The thought never even crossed her parents minds. She got the finger looked at, considered it part of playing basketball, and moved on. And he obviously had more negligence than this dude. He pulled on it. Still, no lawsuit. No going to the principal, no NOTHING.

This girl did not have just a broken finger, she was badly injured and will have pain from it for the rest of her life.

I have broken my right arm twice before I was 10 playing as kids do, both times it took 2-3 days for it to swell up ---I have very high pain tolerance that gets me into big trouble every now and then to this day.

There will be an out of court settlement I am sure and that stupid, ignorant. Coach needs to get first aid training.

Lord I hope you never get a good whack in the balls at work and your manager tells you to  "Suck it up like a man, now go back to work."

There were thousands of people exposed to the toxic dust and smoke of the destroyed World Trade Center. Many people are getting sick from it and some have died as a result. I remember seeing many people fleeing the crashing building. It is going to be much worse than the BP disaster. I would imagine the death toll would be +10,000 from the exposure.

Agreed to that. Some parents feel their children are so entitled to everything. This entitlement culture is killing America besides political correctness. Well, both are related to each other.

Basketball has the most injuries, more so than football and skiing. However, they are not as serious.

If it was such a big deal, mom should have taken her to the doctor sooner, no?  Or is it that the school has deeper pockets than the doc?

Most schools around here require that any child participating in sports have a waiver of liability on file to cover things like this.  Mom will lose.

Oh, and vesta?  You should refrain from posting if you've been drinking...

Lets blame everything on the mother shall we.

Since when is a mother required to know more about first aid then a teacher or coach that has to deal with unexpected injuries at any time.?

The mother was not at the scene of her daughters accident,  the Coach was.

If we parents took our kids to the doctors every time they came home with a twisted ankle or bleeding from a sport related accident it would cause chaos in the ER.

We pay and trust our children's teachers to not only teach but to protect them from harm. We expect them to be able to jump in when needed when a child complains of ANY discomfort.  We do not expect them to ignore or down play their physical complaints.

We do not expect a child to come home from a track meet and complain that the coach made them run on a twisted ankle.

Bare in mind only one of my 4 ever broke a bone as a kid.  The fact that this was a fall from his bike and the bone was protruding was a tip off to me to take him into ER.

With 2 young high spirited boys who had a  no fear attitude the mantra in my home for 5-6 years was              "Don't bleed on the carpet go into the kitchen."

The fact that the Coach never called the mother to see how the girls hand was feeling or even mention her daughter complaining about pain did not cause her to worry too much.  The mother treated her daughter with ice and Tylenol never suspecting anything was seriously wrong.

Dag nabbit it, people get in accidents and not think anything is wrong, then hours later they begin to spit up blood, a rib had snapped puncturing a lung, or they had internal injuries that took hours to present itself.

You Busters get me rilled up when the first thing you can think of is to question or point fingers at the mother of an injured child while the child was in the care of others that ignored her pain.

vesta, what legal obligation does that coach have to take first aid training?  What was his duty to act?  Unless he was an EMT in his spare time, he didn't have one, so the lawsuit is pointless against him.  If he said "take it like a man" that could be considered crude and tactless, but it in no way attaches any liability to him or negates the liability waiver that the school board should have on file.  Mom is just looking for deep pockets to reach into.

I rather go to the hospital than have a coach with no first aid training if I am injured. The coach could make the injury worse.

When my daughter was in elementary school, she "hurt" her finger on the playground. The school clinic was run by PTA moms, and I was in charge of it. The mom "on duty", called me - not her teacher - and told me J had hurt her finger. She had a cold pack on it for about 10 minutes and went back to class. I was told there was no reason to come get her.

Her father, the urologist, looked at it that night, because J was complaining how bad it hurt. He tugged on it a bit, she screeched. He blew it off, and told her it would be ok in a day or two.

Next morning, finger is swollen, J is still complaining, but Daddy the Doctor said it was ok. I sent her off to school.

Couple hours later, I get a call from the clinic, she's back and her hand looks awful, and I'm told to come get her.

I took her to the ER.

She had a broken finger, and the bones had separated. ER doc set it, splinted it, and we went home.

Who should get sued in this case? The school? The teacher who was on playground duty when it happened? Either of the clinic moms who saw her? Me? Her father?

No one...just like this case.

Just like in this case....no one set out to deliberately harm this girl. There was no real negligence on either the part of the coach or her mother. Is there proof that the coach manipulating the girl's finger is what made it worse? How does anyone know it wasn't the kid or her mother's moving the finger didn't do more harm? How many of us have jammed a finger over the years and "messed" with it, trying to make it feel better?

This lawsuit, will cost the school district, and possibly the coach a lot of money, because it most likely will be settled out of court, because the school district and coach's attorneys will agree with the insurance company, that settling will be best for everyone.

The kid and her mother will rake in a nice chunk of change, the attorneys will get paid, the school district's insurance company will raise their rate. making more money from the school district tax payers.

The coach will probably get fired.
