Barfoot lives in the Sussex Square community in far western Henrico; its board of directors rejected a plea from Barfoot in July to approve the pole, disallowing the fixture on aesthetic grounds.

I don't think that would be enforceable...

I hope he tells them to fawk off... UNLESS... unless he knew about the covenants before moving in (not enough info posted to determine), then he loses my support.

HOA are the bane of my husband's existence from living in a suburb of Atlanta, Georgia.  Let's just say there were a lot of arguments between the president and my husband.  Then we moved to Texas where our HOA rules are very specific.  No livestock and no oil derricks in our yard. 

I read this story to my husband and blood started shooting out of his eyes.  He says he would donate to the veteran's legal fees fund.

As the past President of an HOA, they DO serve their purposes IF they are run  with a gentle and guiding hand. In my experience, and I'm sorry if I offend the older crowd,  but the people that were the absolute worst for my HOA were the old people that lived in the town homes. (55+). I don't know what the hell is in their craw, but they were the bane of my leadership. The single family homeowners were easy to deal with. There were times that I'd have to reign in the Architectural Committee. I took Federal Law and crammed it up their butt. If the Honorable Mr. Barfoot looks at the statute passed in 2005, I think that he'll be able to do the same. An association can't pass an ex post facto law or rule when it comes to  covenants, conditions, and restrictions.

My wife, pre-me, lived in one for a while in Maryland that dictated the exact shade that all doors must be, and type and number of lawn decor in the privacy fenced backyards. I couldn't live in one. I imagine a lot of things I do around the house would break most HOA rules.
