Not sure if it's illegal or not.  Several talking heads on both sides of the aisle have said that Obama doesn't need their permission, and he has a hidden motive for putting it to a vote. 

Reid is bringing it up for a vote on Wednesday in the senate.

Barry takes no accountability for ANY decision he makes, unless it happens to be a good one in the eyes of the beholder.

For decisions such as attacking Syria in which there's an entire shitload of stuff ready to go wrong, Barry will blame Congress should they be stupid enough to go down Barry's Highway.

He was hoping for exactly what McLame and Gramnesty did.  They had to demonstrate their great power and wisdom by altering O'Bungles original request so he can blame the almost certain failure on Congress.
