Detaining a shoplifter turned deadly outside an Atlanta-area Wal-Mart early Sunday morning, in a case that recalls a similar, yet not-fatal, assault by Wal-Mart loss prevention staff in 2010.
The deceased man, who appeared to be middle aged, exited through the front door of a Wal-Mart in Lithonia, Georgia with two DVD players that the employees say were stolen. Two Wal-Mart employees as well as a contracted security officer stopped the shoplifting suspect in the parking lot, where a “physical altercation” took place, which included the security officer placing the suspect in a choke-hold, reports the Atlanta Journal-Constitution.

When police arrived, the three Wal-Mart workers were still sitting on top of the motionless suspect. Police quickly realized that the man was unresponsive and bleeding from the nose and mouth. An ambulance transported the man to DMC-Hillandale Hospital, where he was pronounced dead. The medical examiner has not yet released cause of death.

Note to self. Really really avoid Wal-Mart this year.
Take another note to yourself...."don't shoplift".

He wasn't killed while stealing food. He died while stealing a dvd player. There's no currying favor with some dark overlord. A scumbag died doing something selfish and stupid. I have far more sympathy for the other people involved in the incident. They have to live with this.

I don't think anybody was laughing at the death, but this isn't a case where you can draw a link between people being shot by other employees by the employer. I can assure you that Wal-Mart's official policy is that the employees are not supposed to pursue shoplifters. Partially because this can happen and partially because an employee could have been hurt. So this happened because an asshat stole, and then three other people ignored rules that would have prevented this. But the principle responsibility is on the guy who was stealing dvd players. Not Wal-Mart or even the employees.

What will probably happen: Security guards in question will be charged with some variant of manslaughter.

What should happen: Everyone up the chain of command who approved of the training which allowed for choke holds to be used is charged with negligent homicide -- including head of security, Walmart's HR, and possibly other executives.

Come on now cavers, don't you realize that Walmart stole from this man and he was merely retaking what is his?

It's sad how oppressive this country is where shoplifters are detained when they are obviously owed by the evil rich that stole from them in the first place.
I may not lock my doors while sitting at a red light and a black man is near, but I sure as hell grab on tight to my wallet when any democrats are close by.

I would be fine with shooting fleeing sneak thieves, but the Supreme Court disagrees with me on this.

This is Georgia... what will happen is the security guard and the others will not be charged with anything because the State's Attorney will rule that the shoplifter was the leading cause in his own demise.

There was a case at a Wal-Mart in Florida a while back where a man stole a VHS player.  It was summer and had rained even more than usual, but the guy that had a free VHS player wasn't thinking of that as he dashed across the parking lot with a Wal-Mart employee in hot pursuit.  He jumped through some bushes hoping to go through the ditch and across the highway.  Instead he jumped straight into 11 ft. of water.  He didn't know how to swim.  The employee wound up rescuing the shoplifter.

There is no way an honest jury could vote for less; in fact they can triple awards. If the family would donate most of the money to worker rights causes and enforced unionization, and get a federal verdict, we can unionize the entire chain in one fell swoop, or shut it down completely. Either way, this poor man's legacy will live on to inspire millions of other progressive-minded workers.

I would be an honest juror and NOT vote in favor of said suit.

Probably someone at my county courthouse knows my thought process because I have never been called to jury duty.   :hammer:        .....   :-)
