Or the couple lives apart for a year, documented proof provided to the courts ....and then files for divorce.

Several news programs stated that Elizabeth "allowed" John to be there for their children. He wasn't there to comfort her. He was there to comfort his children. If he's capable of that kind of compassion.
Yup that and how he could get away without paying for his illegitimate child. Oh not getting put in jail/prison is on his mind too.
