In testimony at an Article 32 hearing -- the military's version of a grand jury or preliminary hearing -- West said the policeman, Yahya Jhrodi Hamoody, was not cooperating with interrogators, so he watched four of his soldiers from the 220th Field Artillery Battalion beat the detainee on the head and body.

West said he also threatened to kill Hamoody. Military prosecutors say West followed up on that threat by taking the suspect outside, put him on the ground near a weapons clearing barrel and fired his 9 mm pistol into the barrel.

As I recall he received an Article 15 for it, which although a black mark for one's military record, does not count as a conviction of any sort as far as DOJ is concerned once you leave service.  He basically admitted his actions, which were clearly over the line.  The command really did what it had to do in splitting the baby by disciplining him in a way that wouldn't matter for shit once he retired, but at the same time showing that it wasn't going to just turn a blind eye either, because that would have gotten out of control faster than a fire on a lake of gasoline. 

He took his lumps for it like a man, and for that he deserves our deepest respect, not blame from one side or excuse-making from the other.  Doing what you know has to be done, even knowing it probably isn't going to work out that great for you personally, is a critical part of being a military leader.

Col. West did his job, and showed more balls than most GOP congressman. So it's sort of fitting he is one now.

He also later said it was the wrong thing to do.  One of his friends happened to be the JAG lawyer who briefs service members and civilians that go through the CRC at Fort Benning, GA prior to deployment regarding military law and used LTC West's example in the briefing.  That being said, his actions on that night were not war crimes.

As MSS said, how can they support somebody like John Kerrys, who claims to have burned down villages and shot wounded enemies

While serving in Taji, Iraq, on August 20, 2003, as commander of the 2d Battalion, 20th Field Artillery Regiment, Lieutenant Colonel West was in charge of an interrogation of a civilian Iraqi police officer who was suspected of having pertinent information regarding attacks on American soldiers in the area. Interrogators had learned that the detainee had information about a planned ambush. When the interrogators were unable to extract the needed important information for some time, LTC West was asked to come try to obtain the important information. As the detainee continued to hold back the information, LTC West fired his pistol past the detainee's head into a clearing barrel, frightening (but not physically harming) the detainee and getting him to finally give the information. According to Lt. Col. West's sworn statement,[6] the detainee informed West that:

On one hand, they want the body count.  The only time they give a flying **** about US service members is when some benchmark on the number of deaths happens to be set.  At least that is the way it was when Bush was in charge.  With Obama being the head cheese, they now couldn't care less.

On the other hand, there had to be another way.  Knowledge of the attack would have been enough to set up Flask CPs and put AH-64s overhead.

Yeah I know.  But what gets me is that stance they take where they always can end up on the side pointing the finger.  They've have bashed LTC West no matter how he handled that situation.
