INDIANAPOLIS – Certified nursing assistant Brenda Chaney was on duty in an Indiana nursing home one day when she discovered a patient lying on the floor, unable to stand.

But Chaney couldn't help the woman up. She had to search for a white aide because the woman had left instructions that she did not want any black caregivers. And the nursing home insisted it was legally bound to honor the request.

The episode, which led to a recent federal court ruling that Chaney's civil rights had been violated, has brought to light a little known consequence of the patients' rights movement that swept the nation's health care system over the last two decades.

Documents in Chaney's lawsuit, filed in 2008, say her daily assignment sheet at Plainfield Healthcare Center always included the reminder that one patient in her unit "Prefers No Black CNAs."

I'm about 10% sympathetic for the patient, 90% thinking she got exactly what she asked for.

Regardless, they need to outlaw the ability to specify such preferences.

I'm not here to defend the morality of bigotry, but there is lots of information left out of this story - the age of this patient, her mental status, her history of treatment by caregivers, the medications she was on, lots of pertinent data. It could be she was suffering from from dementia or had been the victim of patient abuse once or multiple times in the past by black caregivers. Regardless, when you enter the field of nursing the care you deliver cannot be conditional. I've been exposed to racism from black nursing home residents just as my black co-workers have gotten it from white clients. When people are elderly, suffering, confused,and at the mercy of others, they can say and do things completely different than the way they would act in a younger, more comfortable and self-sufficient time. As a professional who lays claim to any amount of compassion and professionalism, your personal judgment about these peccadilloes on the part of your patient population have to be set aside and care must be delivered in a timely, compassionate and therapeutic manner. All patients have to be viewed as being deserving of equal care. If you can't do that, then you're in the wrong business.

and believe the lawsuit is frivolous on the grounds that the patient specifically asked to be treated this way.

It's called: "Be careful what you wish for."

And the headline should really be: "Patient gets what they asked for."

I've reached my limit of people thinking they can run the world with their personal bigotries. If the facility is required to honor her ridiculous demands she deserves what she gets. They have no obligation to have a white person standing around as her personal servant so she never fear being tainted by anybody with dark skin. She could always get a private duty nurse if she wants to be that damn picky.

Only any idiot would make request like that, but it was her request and the nurse only followed the patients wishes. If one is stupid enough to be racist even when it comes to health, then there isn't much that can be said.

The lawsuit wasn't filed by the patient, it was filed by the nurse.  Amazing what reading comprehension will do for you. 

Apparently a patient requesting not to be helped by a black nurse is a violation of the nurse's rights.

I'm wondering if there might be any other reasons the DUmmies would leave the patient on the floor. Perhaps if they had at some point voiced disgust for homosexuality? Complained about socialistic government? Asked for help with an absentee ballot on which they voted Republican? Been observed watching FOX News on their TV?

True story:

I found out today that I failed to return paperwork on my "Leave of Absence" from HD.

So............according to them I haven't been covered since June 13th.

Well, so much for the surgery to correct the nerve damage in my neck.

HD swears they sent the questionnaire to me twice! I've looked thru everything I have and cannot find said questionnaire.

Who should I blame? HD, Aetna, HD's HR dept, myself?

Guess what DUmmies, I'll lay odds the fault is my own! I get so much BS mail I more than likely overlooked their paperwork and tossed it, which caused a gap in my coverage. The only way I can get outa this is to pay upwards of 2 grand. Well, sorry folks, I have plans for my money and they don't include 2 grand to COBRA at this time. Sure, it's goin' to hurt like hell, it's gonna cause me sleepless nights due to the pain I have to accept. I'm gonna have to pay my own way for anything I need for a year, but I'm gonna use that 2 grand + a little more to put myself into self employment rather than become a ward of the State!

Looks like I'll have to get onto "Toots'" insurance and wait a year for the surgery I need. Oh well, life sucks! No one ever promised me a "Rose Garden", and I have never expected one. I've certainly been in rougher shape.

How many of you lead paint sniffin', wards of the state, victims, are willing to accept responsibility for your own actions?

Answer, NONE!!!! Not just none, ****in' none!!!!

Even if your messiah, answer to all that ails the world, offered to help me, I would turn it down! I don't believe my fellow Patriots should foot the bill for my mistakes! Could I go on disability? Sure! Will I? **** no! I'm still able to take care of myself, somethin' you asshats won't even consider!
